88 AN ACT
99 relating to required mental health awareness training for first
1010 responders.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle B, Title 9, Health and Safety Code, is
1313 amended by adding Chapter 786 to read as follows:
1414 CHAPTER 786. MENTAL HEALTH AWARENESS TRAINING
1515 FOR FIRST RESPONDERS
1616 Sec. 786.001. DEFINITIONS. In this chapter:
1717 (1) "Commission" means the Health and Human Services
1818 Commission.
1919 (2) "First responder" has the meaning assigned by
2020 Section 421.095, Government Code.
2121 (3) "First responder training program" means a program
2222 that provides training required for certification or licensure as a
2323 first responder, including the training required under:
2424 (A) Chapter 773;
2525 (B) Chapter 419, Government Code; and
2626 (C) Chapter 1701, Occupations Code.
2727 Sec. 786.002. REQUIRED MENTAL HEALTH AWARENESS TRAINING.
2828 (a) A person who provides to first responders and first responder
2929 trainees a first responder training program shall:
3030 (1) include as part of the program at least six hours
3131 of training on mental health awareness that covers:
3232 (A) the most common mental health issues first
3333 responders experience;
3434 (B) the impact of chronic trauma on a first
3535 responder's duties;
3636 (C) signs and symptoms of mental illness; and
3737 (D) strategies for first responders to attain
3838 mental wellness and resiliency; and
3939 (2) require first responders and first responder
4040 trainees to successfully complete the training described by
4141 Subdivision (1) as part of the program.
4242 (b) In providing the training described by Subsection (a), a
4343 person who provides a first responder training program must use a
4444 mental health awareness training curriculum developed or adopted
4545 under Section 786.003.
4646 Sec. 786.003. MENTAL HEALTH AWARENESS TRAINING CURRICULUM.
4747 (a) The commission shall develop or adopt a curriculum for the
4848 first responder mental health awareness training required by
4949 Section 786.002. In developing or adopting the curriculum, the
5050 commission shall collaborate with state agencies that certify or
5151 license first responders.
5252 (b) Each state agency that certifies or licenses first
5353 responders shall ensure the applicable first responder training
5454 program required for certification or licensure as a first
5555 responder uses the mental health awareness training curriculum
5656 developed or adopted by the commission under this section.
5757 SECTION 2. Section 1701.253, Occupations Code, is amended
5858 by adding Subsection (u) to read as follows:
5959 (u) As part of the minimum curriculum requirements, the
6060 commission shall require an officer to complete the mental health
6161 awareness training curriculum the Health and Human Services
6262 Commission develops or adopts under Section 786.003, Health and
6363 Safety Code.
6464 SECTION 3. (a) As soon as practicable after the effective
6565 date of this Act:
6666 (1) the Health and Human Services Commission shall
6767 develop or adopt the first responder mental health awareness
6868 training curriculum required by Section 786.003, Health and Safety
6969 Code, as added by this Act; and
7070 (2) each state agency that certifies or licenses first
7171 responders subject to Chapter 786, Health and Safety Code, as added
7272 by this Act, shall ensure:
7373 (A) each first responder training program
7474 subject to the chapter includes the mental health awareness
7575 training and curriculum required by that chapter; and
7676 (B) each first responder and first responder
7777 trainee subject to the chapter completes the required training.
7878 (b) Not later than January 1, 2028, a peace officer or
7979 reserve law enforcement officer who holds a license issued under
8080 Chapter 1701, Occupations Code, on or before January 1, 2026, shall
8181 complete the mental health awareness training curriculum required
8282 by Section 1701.253(u), Occupations Code, as added by this Act.
8383 SECTION 4. This Act takes effect September 1, 2025.
