77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the policies and procedures of a public school's threat
1010 assessment and safe and supportive school team and threat
1111 assessment review team.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 37.115(a), Education Code, is amended by
1414 adding Subdivision (1-a) to read as follows:
1515 (1-a) "Review team" means a threat assessment review
1616 team established by the board of trustees of a school district under
1717 this section.
1818 SECTION 2. Section 37.115, Education Code, is amended by
1919 reenacting and amending Subsection (c), as amended by Chapters 896
2020 (H.B. 3) and 948 (S.B. 1720), Acts of the 88th Legislature, Regular
2121 Session, 2023, and adding Subsection (c-1) to read as follows:
2222 (c) The board of trustees of each school district shall
2323 establish a threat assessment and safe and supportive school team
2424 and a threat assessment review team to serve at each campus of the
2525 district and shall adopt policies and procedures for the teams and
2626 review teams.
2727 (c-1) A [The] team must be composed of at least three
2828 members and is responsible for developing and implementing the safe
2929 and supportive school program under Subsection (b) at the district
3030 campus served by the team. The policies and procedures adopted
3131 under this section must:
3232 (1) be consistent with the model policies and
3333 procedures developed by the Texas School Safety Center;
3434 (2) require each team and review team to complete
3535 training provided by the Texas School Safety Center or a regional
3636 education service center regarding evidence-based threat
3737 assessment programs;
3838 (3) require each team and review team established
3939 under Subsection (c) [this section] to report the information
4040 required under Subsection (k) regarding the team's or review
4141 team's, as applicable, activities to the agency; [and]
4242 (4) provide for:
4343 (A) a district employee who reports a potential
4444 threat to a team to elect for the employee's identity to be
4545 confidential and not subject to disclosure under Chapter 552,
4646 Government Code, except as necessary for the team, the district, or
4747 law enforcement to investigate the potential threat; and
4848 (B) the district to maintain a record of the
4949 identity of a district employee who elects for the employee's
5050 identity to be confidential under Paragraph (A); and
5151 (5) [(4)] require each district campus to establish a
5252 clear procedure for a student to report concerning behavior
5353 exhibited by another student for assessment by the team or other
5454 appropriate school employee.
5555 SECTION 3. Section 37.115, Education Code, is amended by
5656 adding Subsections (f-3), (h-1), and (h-2) and amending Subsection
5757 (h) to read as follows:
5858 (f-3) Before a team may conduct a threat assessment of an
5959 individual, at least two-thirds of the members of the team must
6060 agree that a threat assessment is necessary.
6161 (h) On a determination that a student or other individual
6262 poses a serious risk of violence to self or others, a team must
6363 immediately report that determination to the campus's review team
6464 for review of the determination.
6565 (h-1) On confirmation by a campus's review team under
6666 Subsection (h) that a student or other individual poses a serious
6767 risk of violence to self or others, a team shall immediately report
6868 the team's determination to the superintendent. If the individual
6969 is a student, the superintendent shall immediately attempt to
7070 inform the parent or person standing in parental relation to the
7171 student. The requirements of this subsection do not prevent an
7272 employee of the school from acting immediately to prevent an
7373 imminent threat or respond to an emergency.
7474 (h-2) A campus's review team shall review any threat
7575 assessment of a student conducted by the team serving that campus to
7676 determine whether information related to the threat assessment
7777 should be included in the student's disciplinary or other school
7878 records.
7979 SECTION 4. To the extent of any conflict, this Act prevails
8080 over another Act of the 89th Legislature, Regular Session, 2025,
8181 relating to nonsubstantive additions to and corrections in enacted
8282 codes.
8383 SECTION 5. This Act applies beginning with the 2025-2026
8484 school year.
8585 SECTION 6. This Act takes effect immediately if it receives
8686 a vote of two-thirds of all the members elected to each house, as
8787 provided by Section 39, Article III, Texas Constitution. If this
8888 Act does not receive the vote necessary for immediate effect, this
8989 Act takes effect September 1, 2025.
