8	8	AN ACT
9	9	relating to the policies and procedures of a public school's threat
10	10	assessment and safe and supportive school team and threat
11	11	assessment review team.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 37.115(a), Education Code, is amended by
14	14	adding Subdivision (1-a) to read as follows:
15	15	(1-a) "Review team" means a threat assessment review
16	16	team established by the board of trustees of a school district under
17	17	this section.
18	18	SECTION 2. Section 37.115, Education Code, is amended by
19	19	reenacting and amending Subsection (c), as amended by Chapters 896
20	20	(H.B. 3) and 948 (S.B. 1720), Acts of the 88th Legislature, Regular
21	21	Session, 2023, and adding Subsection (c-1) to read as follows:
22	22	(c) The board of trustees of each school district shall
23	23	establish a threat assessment and safe and supportive school team
24	24	and a threat assessment review team to serve at each campus of the
25	25	district and shall adopt policies and procedures for the teams and
26	26	review teams.
27	27	(c-1) A [The] team must be composed of at least three
28	28	members and is responsible for developing and implementing the safe
29	29	and supportive school program under Subsection (b) at the district
30	30	campus served by the team. The policies and procedures adopted
31	31	under this section must:
32	32	(1) be consistent with the model policies and
33	33	procedures developed by the Texas School Safety Center;
34	34	(2) require each team and review team to complete
35	35	training provided by the Texas School Safety Center or a regional
36	36	education service center regarding evidence-based threat
37	37	assessment programs;
38	38	(3) require each team and review team established
39	39	under Subsection (c) [this section] to report the information
40	40	required under Subsection (k) regarding the team's or review
41	41	team's, as applicable, activities to the agency; [and]
42	42	(4) provide for:
43	43	(A) a district employee who reports a potential
44	44	threat to a team to elect for the employee's identity to be
45	45	confidential and not subject to disclosure under Chapter 552,
46	46	Government Code, except as necessary for the team, the district, or
47	47	law enforcement to investigate the potential threat; and
48	48	(B) the district to maintain a record of the
49	49	identity of a district employee who elects for the employee's
50	50	identity to be confidential under Paragraph (A); and
51	51	(5) [(4)] require each district campus to establish a
52	52	clear procedure for a student to report concerning behavior
53	53	exhibited by another student for assessment by the team or other
54	54	appropriate school employee.
55	55	SECTION 3. Section 37.115, Education Code, is amended by
56	56	adding Subsections (f-3), (h-1), and (h-2) and amending Subsection
57	57	(h) to read as follows:
58	58	(f-3) Before a team may conduct a threat assessment of an
59	59	individual, at least two-thirds of the members of the team must
60	60	agree that a threat assessment is necessary.
61	61	(h) On a determination that a student or other individual
62	62	poses a serious risk of violence to self or others, a team must
63	63	immediately report that determination to the campus's review team
64	64	for review of the determination.
65	65	(h-1) On confirmation by a campus's review team under
66	66	Subsection (h) that a student or other individual poses a serious
67	67	risk of violence to self or others, a team shall immediately report
68	68	the team's determination to the superintendent. If the individual
69	69	is a student, the superintendent shall immediately attempt to
70	70	inform the parent or person standing in parental relation to the
71	71	student. The requirements of this subsection do not prevent an
72	72	employee of the school from acting immediately to prevent an
73	73	imminent threat or respond to an emergency.
74	74	(h-2) A campus's review team shall review any threat
75	75	assessment of a student conducted by the team serving that campus to
76	76	determine whether information related to the threat assessment
77	77	should be included in the student's disciplinary or other school
78	78	records.
79	79	SECTION 4. To the extent of any conflict, this Act prevails
80	80	over another Act of the 89th Legislature, Regular Session, 2025,
81	81	relating to nonsubstantive additions to and corrections in enacted
82	82	codes.
83	83	SECTION 5. This Act applies beginning with the 2025-2026
84	84	school year.
85	85	SECTION 6. This Act takes effect immediately if it receives
86	86	a vote of two-thirds of all the members elected to each house, as
87	87	provided by Section 39, Article III, Texas Constitution. If this
88	88	Act does not receive the vote necessary for immediate effect, this
89	89	Act takes effect September 1, 2025.
