77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to enhancing the criminal penalty for the offense of
1010 intoxication assault in certain circumstances.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 49.09(b-1) and (b-2), Penal Code, are
1313 amended to read as follows:
1414 (b-1) An offense under Section 49.07 is:
1515 (1) a felony of the second degree if it is shown on the
1616 trial of the offense that:
1717 (A) the person caused serious bodily injury to a
1818 firefighter or emergency medical services personnel while in the
1919 actual discharge of an official duty; or
2020 (B) the person has previously been convicted:
2121 (i) one time of an offense under Section
2222 49.07 or 49.08 or an offense under the laws of another state if the
2323 offense contains elements that are substantially similar to the
2424 elements of an offense under Section 49.07 or 49.08; or
2525 (ii) two times of any other offense
2626 relating to the operating of a motor vehicle while intoxicated,
2727 operating an aircraft while intoxicated, operating a watercraft
2828 while intoxicated, or operating or assembling an amusement ride
2929 while intoxicated; or
3030 (2) a felony of the first degree if it is shown on the
3131 trial of the offense that the person caused serious bodily injury to
3232 a peace officer or judge while the officer or judge was in the
3333 actual discharge of an official duty.
3434 (b-2) An offense under Section 49.08 is a felony of the
3535 first degree if it is shown on the trial of the offense that the
3636 person caused the death of a person described by Subsection
3737 (b-1)(1)(A) or (2) [(b-1)].
3838 SECTION 2. The change in law made by this Act applies only
3939 to an offense committed on or after the effective date of this Act.
4040 An offense committed before the effective date of this Act is
4141 governed by the law in effect on the date the offense was committed,
4242 and the former law is continued in effect for that purpose. For
4343 purposes of this section, an offense was committed before the
4444 effective date of this Act if any element of the offense occurred
4545 before that date.
4646 SECTION 3. This Act takes effect September 1, 2025.
