77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the operation of a fraud, waste, and abuse hotline and a
1010 duty to provide employees and the public with certain hotline
1111 information.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1414 amended by adding Section 38.0043 to read as follows:
1515 Sec. 38.0043. POSTING FRAUD, WASTE, AND ABUSE HOTLINE
1616 INFORMATION. Each public school and open-enrollment charter school
1717 shall prominently post the telephone number for the fraud, waste,
1818 and abuse hotline established under Section 321.024, Government
1919 Code, and information relating to reporting suspected fraud, waste,
2020 and abuse to the hotline:
2121 (1) on the school's Internet website; and
2222 (2) in each physical administrative office maintained
2323 by the school.
2424 SECTION 2. Chapter 321, Government Code, is amended by
2525 adding Section 321.024 to read as follows:
2626 Sec. 321.024. FRAUD, WASTE, AND ABUSE HOTLINE; REPORT. (a)
2727 The State Auditor shall operate a telephone hotline for submission
2828 of reports of suspected fraud, waste, and abuse.
2929 (b) The State Auditor shall refer each submitted report of
3030 suspected fraud, waste, or abuse to the appropriate state agency.
3131 On receipt of the report, the state agency shall investigate the
3232 suspected fraud, waste, or abuse and on completion of the
3333 investigation disclose the results of the investigation to the
3434 State Auditor.
3535 (c) Not later than September 1 of each odd-numbered year,
3636 the State Auditor shall prepare and submit to the legislature and
3737 each standing committee having jurisdiction over state agency
3838 fraud, waste, and abuse a report summarizing:
3939 (1) any reports of suspected fraud, waste, or abuse
4040 submitted to the hotline;
4141 (2) each state agency to which the State Auditor
4242 referred for investigation a report of suspected fraud, waste, or
4343 abuse; and
4444 (3) the results of any investigation conducted by a
4545 state agency after referral of a report of suspected fraud, waste,
4646 or abuse.
4747 SECTION 3. Subtitle B, Title 6, Government Code, is amended
4848 by adding Chapter 674 to read as follows:
4949 CHAPTER 674. INFORMATION RELATING TO FRAUD, WASTE, AND ABUSE
5050 HOTLINE
5151 Sec. 674.001. DEFINITION. In this chapter, "state agency"
5252 has the meaning assigned by Section 2054.003.
5353 Sec. 674.002. REQUIRED INFORMATION ON FRAUD, WASTE, AND
5454 ABUSE HOTLINE. A state agency shall provide to each new employee
5555 the telephone number for the fraud, waste, and abuse hotline
5656 established under Section 321.024 and information on the procedure
5757 for submitting a report of suspected fraud, waste, or abuse to the
5858 hotline.
5959 SECTION 4. Subchapter F, Chapter 2054, Government Code, is
6060 amended by adding Section 2054.139 to read as follows:
6161 Sec. 2054.139. REQUIRED POSTING OF FRAUD, WASTE, AND ABUSE
6262 HOTLINE INFORMATION. Each state agency and local government shall
6363 prominently post the telephone number for the fraud, waste, and
6464 abuse hotline established under Section 321.024 and information on
6565 the procedure for submitting a report of suspected fraud, waste, or
6666 abuse to the hotline:
6767 (1) on the agency's or local government's Internet
6868 website; and
6969 (2) in each physical administrative office maintained
7070 by the agency or local government.
7171 SECTION 5. Chapter 180, Local Government Code, is amended
7272 by adding Section 180.011 to read as follows:
7373 Sec. 180.011. REQUIRED INFORMATION ON FRAUD, WASTE, AND
7474 ABUSE HOTLINE. (a) In this section, "political subdivision" has
7575 the meaning assigned by Section 180.008.
7676 (b) A political subdivision shall provide to each new
7777 employee the telephone number for the fraud, waste, and abuse
7878 hotline established under Section 321.024, Government Code, and
7979 information on the procedure for submitting a report of suspected
8080 fraud, waste, or abuse to the hotline.
8181 SECTION 6. This Act takes effect September 1, 2025.
