| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 34, Utilities Code, is |
|---|
| 13 | 13 | | amended by adding Section 34.01015 to read as follows: |
|---|
| 14 | 14 | | Sec. 34.01015. APPLICABILITY. For the purposes of this |
|---|
| 15 | 15 | | chapter: |
|---|
| 16 | 16 | | (1) an electric generating facility is considered to |
|---|
| 17 | 17 | | be dispatchable if the facility's output can be controlled |
|---|
| 18 | 18 | | primarily by forces under human control; and |
|---|
| 19 | 19 | | (2) an electric generating facility that uses |
|---|
| 20 | 20 | | petroleum, natural gas, coal, geothermal energy, hydroelectric |
|---|
| 21 | 21 | | energy, or nuclear energy as the primary energy source is |
|---|
| 22 | 22 | | considered to be dispatchable. |
|---|
| 23 | 23 | | SECTION 2. Section 34.0104(a), Utilities Code, is amended |
|---|
| 24 | 24 | | to read as follows: |
|---|
| 25 | 25 | | (a) The commission may use money in the fund without further |
|---|
| 26 | 26 | | appropriation to provide loans to finance upgrades to existing |
|---|
| 27 | 27 | | dispatchable electric generating facilities providing power for |
|---|
| 28 | 28 | | the ERCOT power region that result in a net increase of at least 100 |
|---|
| 29 | 29 | | megawatts of capacity for each facility or the construction of |
|---|
| 30 | 30 | | dispatchable electric generating facilities providing power for |
|---|
| 31 | 31 | | the ERCOT power region that each have a generation capacity of at |
|---|
| 32 | 32 | | least 100 megawatts. [For the purposes of this section, a |
|---|
| 33 | 33 | | generating facility is considered to be dispatchable if the |
|---|
| 34 | 34 | | facility's output can be controlled primarily by forces under human |
|---|
| 35 | 35 | | control.] An electric energy storage facility is not eligible for |
|---|
| 36 | 36 | | a loan under this section. |
|---|
| 37 | 37 | | SECTION 3. Section 34.0105(a), Utilities Code, is amended |
|---|
| 38 | 38 | | to read as follows: |
|---|
| 39 | 39 | | (a) The commission shall provide, using money available in |
|---|
| 40 | 40 | | the fund for the purpose without further appropriation, a |
|---|
| 41 | 41 | | completion bonus grant for the construction of dispatchable |
|---|
| 42 | 42 | | electric generating facilities in the ERCOT power region. [For the |
|---|
| 43 | 43 | | purposes of this section, a generating facility is considered to be |
|---|
| 44 | 44 | | dispatchable if the facility's output can be controlled primarily |
|---|
| 45 | 45 | | by forces under human control.] An electric energy storage |
|---|
| 46 | 46 | | facility is not eligible for a grant under this section. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect September 1, 2025. |
