77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the dedication of revenue received from certain
1010 oversize or overweight vehicle permits to the state highway fund.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 623.0171(l), Transportation Code, is
1313 reenacted to read as follows:
1414 (l) Of the fee collected under this section for a permit:
1515 (1) 50 percent of the amount collected shall be
1616 deposited to the credit of the state highway fund; and
1717 (2) the other 50 percent shall be divided among and
1818 distributed to the counties designated in permit applications under
1919 Subsection (k) according to department rule.
2020 SECTION 2. Section 623.324(a), Transportation Code, is
2121 reenacted to read as follows:
2222 (a) Of the fee collected under Section 623.322 for a permit:
2323 (1) 50 percent of the amount collected shall be
2424 deposited to the credit of the state highway fund; and
2525 (2) the other 50 percent shall be divided equally
2626 among all counties designated in the permit application under
2727 Section 623.322(a)(2).
2828 SECTION 3. Notwithstanding Chapter 839 (H.B. 6), Acts of
2929 the 83rd Legislature, Regular Session, 2013, money dedicated by
3030 Sections 623.0171(l) and 623.324(a), Transportation Code, as added
3131 by Chapter 1135 (H.B. 2741), Acts of the 83rd Legislature, Regular
3232 Session, 2013, to the state highway fund is rededicated by this Act.
3333 SECTION 4. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2025.
