| 9 | 9 | | relating to the dedication of revenue received from certain |

| 10 | 10 | | oversize or overweight vehicle permits to the state highway fund. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 623.0171(l), Transportation Code, is |
|---|
| 13 | 13 | | reenacted to read as follows: |
|---|
| 14 | 14 | | (l) Of the fee collected under this section for a permit: |
|---|
| 15 | 15 | | (1) 50 percent of the amount collected shall be |
|---|
| 16 | 16 | | deposited to the credit of the state highway fund; and |
|---|
| 17 | 17 | | (2) the other 50 percent shall be divided among and |
|---|
| 18 | 18 | | distributed to the counties designated in permit applications under |
|---|
| 19 | 19 | | Subsection (k) according to department rule. |
|---|
| 20 | 20 | | SECTION 2. Section 623.324(a), Transportation Code, is |
|---|
| 21 | 21 | | reenacted to read as follows: |
|---|
| 22 | 22 | | (a) Of the fee collected under Section 623.322 for a permit: |
|---|
| 23 | 23 | | (1) 50 percent of the amount collected shall be |
|---|
| 24 | 24 | | deposited to the credit of the state highway fund; and |
|---|
| 25 | 25 | | (2) the other 50 percent shall be divided equally |
|---|
| 26 | 26 | | among all counties designated in the permit application under |
|---|
| 27 | 27 | | Section 623.322(a)(2). |

| 28 | 28 | | SECTION 3. Notwithstanding Chapter 839 (H.B. 6), Acts of |
|---|
| 29 | 29 | | the 83rd Legislature, Regular Session, 2013, money dedicated by |
|---|
| 30 | 30 | | Sections 623.0171(l) and 623.324(a), Transportation Code, as added |
|---|
| 31 | 31 | | by Chapter 1135 (H.B. 2741), Acts of the 83rd Legislature, Regular |
|---|
| 32 | 32 | | Session, 2013, to the state highway fund is rededicated by this Act. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2025. |
