5	7		AN ACT
6	8		relating to the creation of a statewide Chronic Wasting Disease
7	9		plan.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Chapter 11, Parks and Wildlife Code, is amended
10	12		by adding Subchapter Q to read as follows:
11	13		SUBCHAPTER Q. CHRONIC WASTING DISEASE IN DEER.
12	14		Sec. 1.01. ASSESSMENT BY THE TEXAS A&M COLLEGE OF
13	15		VETERINARY MEDICINE AND BIOMEDICAL SCIENCES. (a) The Texas A&M
14	16		College of Veterinary Medicine and Biomedical Sciences shall
15	17		evaluate the Texas Department of Parks and Wildlife's overall
16	18		Chronic Wasting Disease management since 2015 in general and the
17	19		department's implementation of the Texas Department of Parks and
18	20		Wildlife's August 2020 Chronic Wasting Disease Management Plan.
19	21		(b) The Texas A&M College of Veterinary Medicine and
20	22		Biomedical Sciences shall compare the Texas Department of Parks and
21	23		Wildlife's overall Chronic Wasting Disease management since 2015 in
22	24		general and the department's implementation of the Texas
23	25		Department of Parks and Wildlife's August 2020 Chronic Wasting
24	26		Disease Management Plan to:
25	27		(1) Other states' plans and policies related to Chronic
26	28		Wasting Disease in deer;
27	29		(2) Any national standards related to Chronic Wasting
28	30		Disease in deer; and
29	31		(3) Any generally accepted practices related to Chronic
30	32		Wasting Disease in deer.
31	33		(c) The Texas A&M College of Veterinary Medicine and
32	34		Biomedical Sciences shall create a Statewide Chronic Wasting
33	35		Disease Plan that describes plans and policies used by other
34	36		states, national standards, and any other generally accepted
35	37		practices related to Chronic Wasting Disease in deer.
36	38		(d) The executive director of the Texas Department of Parks
37	39		and Wildlife shall implement the practices described by the Texas
38	40		A&M College of Veterinary Medicine and Biomedical Sciences'
39	41		Statewide plan related to Chronic Wasting Disease in the state's
40	42		deer population.
41	43		(e) The Texas A&M College of Veterinary Medicine and
42	44		Biomedical Sciences shall monitor the Texas Department of Parks
43	45		and Wildlife's implementation of the Statewide Chronic Wasting
44	46		Disease Plan. The Texas A&M College of Veterinary Medicine and
45	47		Biomedical Sciences shall create a report detailing the Texas
46	48		Department of Parks and Wildlife's implementation of the Statewide
47	49		Chronic Wasting Disease Plan. The Texas A&M College of Veterinary
48	50		Medicine and Biomedical Sciences shall send the report to each
49	51		member of the legislature, the lieutenant governor, and the Texas
50	52		Sunset Commission before the beginning of each legislative session.
51	53		SECTION 2. Chapter 161, Agriculture Code, is amended by
52	54		adding Subchapter I to read as follows:
53	55		SUBCHAPTER I. CHRONIC WASTING DISEASE IN DEER.
54	56		Sec. 1.01. ASSESSMENT BY THE TEXAS A&M COLLEGE OF
55	57		VETERINARY MEDICINE AND BIOMEDICAL SCIENCES. (a) The Texas A&M
56	58		College of Veterinary Medicine and Biomedical Sciences shall
57	59		evaluate the Texas Animal Health Commission's overall Chronic
58	60		Wasting Disease management since 2015 in general and the
59	61		department's implementation of the Texas Department of Parks and
60	62		Wildlife's August 2020 Chronic Wasting Disease Management Plan.
61	63		(b) The Texas A&M College of Veterinary Medicine and
62	64		Biomedical Sciences shall compare the Texas Animal Health
63	65		Commission's overall Chronic Wasting Disease management since 2015
64	66		in general and the Texas Animal Commission's implementation of the
65	67		Texas Department of Parks and Wildlife's August 2020 Chronic
66	68		Wasting Disease Management Plan to:
67	69		(1) Other states' plans and policies related to Chronic
68	70		Wasting Disease in deer;
69	71		(2) Any national standards related to Chronic Wasting
70	72		Disease in deer; and
71	73		(3) Any generally accepted practices related to Chronic
72	74		Wasting Disease in deer.
73	75		(c) The Texas A&M College of Veterinary Medicine and
74	76		Biomedical Sciences shall create a Statewide Chronic Wasting
75	77		Disease Plan that describes plans and policies used by other
76	78		states, national standards, and any other generally accepted
77	79		practices related to Chronic Wasting Disease in deer.
78	80		(d) The executive director of the Texas Animal Health
79	81		Commission shall implement the practices described by the Texas A&M
80	82		College of Veterinary Medicine and Biomedical Sciences' Statewide
81	83		related to Chronic Wasting Disease in the state's deer population.
82	84		(e) The Texas A&M College of Veterinary Medicine and
83	85		Biomedical Sciences shall monitor the Texas Animal Health
84	86		Commission's implementation of the Statewide Chronic Wasting
85	87		Disease Plan. The Texas A&M College of Veterinary Medicine and
86	88		Biomedical Sciences shall create a report detailing the Texas
87	89		Animal Health Commission's implementation of the Statewide Chronic
88	90		Wasting Disease Plan. The Texas A&M College of Veterinary Medicine
89	91		and Biomedical Sciences shall send the report to each member of the
90	92		legislature, the lieutenant governor, and the Texas Sunset
91	93		Commission before the beginning of each legislative session.
92	94		SECTION 3. This Act takes effect immediately if it receives
93	95		a vote of two-thirds of all the members elected to each house, as
94	96		provided by Section 39, Article III, Texas Constitution. If this
95	97		Act does not receive the vote necessary for immediate effect, this
96	98		Act takes effect September 1, 2025.
