77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prohibited provision of certain residential
1010 caregiver services by individuals with certain criminal
1111 convictions; creating a criminal offense.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 531.02485, Government Code, is
1414 transferred to Subchapter D, Chapter 532, Government Code, as
1515 effective April 1, 2025, redesignated as Section 532.0157,
1616 Government Code, and amended to read as follows:
1717 Sec. 532.0157 [531.02485]. REQUIRED REVIEW OF CRIMINAL
1818 HISTORY RECORD INFORMATION FOR CERTAIN RESIDENTIAL CAREGIVERS;
1919 CRIMINAL OFFENSE. (a) In this section, "residential caregiver"
2020 means an individual who provides, through a group home or other
2121 residential facility licensed by or operated under the authority of
2222 the commission, community-based residential care services:
2323 (1) to not more than four individuals with an
2424 intellectual or developmental disability at any time; and
2525 (2) at a residence other than the home of the
2626 individual providing the services.
2727 (b) A Medicaid provider, including a provider providing
2828 services under a 1915(c) waiver program, that employs or contracts
2929 with a residential caregiver to provide community-based
3030 residential care services to [Medicaid] recipients shall review
3131 state and federal criminal history record information and obtain
3232 electronic updates from the Department of Public Safety of arrests
3333 and convictions for each residential caregiver the provider employs
3434 or contracts with to provide community-based residential care
3535 services to [Medicaid] recipients.
3636 (c) An individual who has been convicted of an offense
3737 described by Section 250.006, Health and Safety Code, may not be
3838 employed or contracted as a residential caregiver or otherwise
3939 provide direct care to a [Medicaid] recipient with an intellectual
4040 or developmental disability to the same extent and, if applicable,
4141 for the same period of time prescribed by Section 250.006(a) or (b),
4242 Health and Safety Code, as an individual similarly convicted under
4343 those subsections. An individual who violates this subsection is
4444 subject to disciplinary action by the commission. An individual who
4545 violates this subsection commits an offense. An offense under this
4646 subsection is a Class A misdemeanor.
4747 (d) A Medicaid provider shall immediately discharge any
4848 individual the provider employs or contracts with as a residential
4949 caregiver who is convicted of an offense described by Section
5050 250.006, Health and Safety Code.
5151 (e) Notwithstanding any other law, the commission shall
5252 take disciplinary action against a Medicaid provider that violates
5353 this section, including imposing an administrative penalty or
5454 vendor hold, terminating a contract or license, or any other
5555 disciplinary action the commission determines appropriate. In
5656 determining the appropriate disciplinary action to take against a
5757 Medicaid provider under this subsection, the commission shall
5858 consider:
5959 (1) the nature and seriousness of the violation;
6060 (2) the history of previous violations; and
6161 (3) any other matter justice may require.
6262 (f) The executive commissioner shall adopt rules necessary
6363 to implement this section.
6464 SECTION 2. To the extent of any conflict, this Act prevails
6565 over another Act of the 89th Legislature, Regular Session, 2025,
6666 relating to nonsubstantive additions to and corrections in enacted
6767 codes.
6868 SECTION 3. This Act takes effect September 1, 2025.
