88 AN ACT
99 relating to the confidentiality of fraud detection and deterrence
1010 information under the public information law.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1313 amended by adding Section 552.164 to read as follows:
1414 Sec. 552.164. EXCEPTION: CONFIDENTIALITY OF INFORMATION
1515 REGARDING FRAUD DETECTION AND DETERRENCE MEASURES. Information in
1616 the custody of a governmental body that relates to fraud detection
1717 and deterrence measures is confidential and excepted from the
1818 requirements of Section 552.021. For purposes of this section,
1919 fraud detection information includes risk assessments, reports,
2020 data, protocols, technology specifications, manuals, instructions,
2121 investigative materials, crossmatches, mental impressions, and
2222 communications that may reveal the methods or means by which a
2323 governmental body prevents, investigates, or evaluates fraud.
2424 SECTION 2. This Act takes effect September 1, 2025.
