88 AN ACT
99 relating to required disclosures on political advertising
1010 supporting or opposing certain officeholders; authorizing a civil
1111 penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 255, Election Code, is amended by adding
1414 Section 255.009 to read as follows:
1515 Sec. 255.009. REQUIRED DISCLOSURE ON POLITICAL ADVERTISING
1616 SUPPORTING OR OPPOSING CERTAIN OFFICEHOLDERS; CIVIL PENALTY. (a)
1717 A person may not knowingly cause to be published, distributed, or
1818 broadcast political advertising supporting or opposing an
1919 officeholder whose name is not on an election ballot at the time the
2020 political advertising is published, distributed, or broadcast
2121 unless the political advertising indicates in the form and manner
2222 the commission requires by rule:
2323 (1) that the political advertising was paid for; and
2424 (2) the full name of the person who paid for the
2525 political advertising.
2626 (b) A person who violates this section is liable to this
2727 state for a civil penalty in an amount the commission determines not
2828 to exceed $4,000.
2929 SECTION 2. This Act takes effect September 1, 2025.
