12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Chapter 255, Election Code, is amended by adding | |
14 | 14 | Section 255.009 to read as follows: | |
15 | 15 | Sec. 255.009. REQUIRED DISCLOSURE ON POLITICAL ADVERTISING | |
16 | 16 | SUPPORTING OR OPPOSING CERTAIN OFFICEHOLDERS; CIVIL PENALTY. (a) | |
17 | 17 | A person may not knowingly cause to be published, distributed, or | |
18 | 18 | broadcast political advertising supporting or opposing an | |
19 | 19 | officeholder whose name is not on an election ballot at the time the | |
20 | 20 | political advertising is published, distributed, or broadcast | |
21 | 21 | unless the political advertising indicates in the form and manner | |
22 | 22 | the commission requires by rule: | |
23 | 23 | (1) that the political advertising was paid for; and | |
24 | 24 | (2) the full name of the person who paid for the | |
25 | 25 | political advertising. | |
26 | 26 | (b) A person who violates this section is liable to this | |
27 | 27 | state for a civil penalty in an amount the commission determines not | |
28 | 28 | to exceed $4,000. | |
29 | 29 | SECTION 2. This Act takes effect September 1, 2025. |
