46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the disclosure of citizenship of a candidate for public
79 office.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Subchapter (B), Section 141.0031, Election Code,
1012 is amended by adding Subsections (N) and (O) to read as follows:
1113 (4) include:
1214 (A) the candidate's name;
1315 (B) the candidate's occupation;
1416 (C) the office sought, including any place number or
1517 other distinguishing number;
1618 (D) an indication of whether the office sought is to be
1719 filled for a full or unexpired term if the office sought and another
1820 office to be voted on have the same title but do not have place
1921 numbers or other distinguishing numbers;
2022 (E) a statement that the candidate is a United States
2123 citizen;
2224 (F) a statement that the candidate has not been
2325 determined by a final judgment of a court exercising probate
2426 jurisdiction to be:
2527 (i) totally mentally incapacitated; or
2628 (ii) partially mentally incapacitated without the
2729 right to vote;
2830 (G) an indication that the candidate has either not
2931 been finally convicted of a felony or if so convicted has been
3032 pardoned or otherwise released from the resulting disabilities;
3133 (H) the candidate's date of birth;
3234 (I) the candidate's residence address or, if the
3335 residence has no address, the address at which the candidate
3436 receives mail and a concise description of the location of the
3537 candidate's residence;
3638 (J) the candidate's length of continuous residence in
3739 the state and in the territory from which the office sought is
3840 elected as of the date the candidate swears to the application;
3941 (K) the statement: "I, __________, of __________
4042 County, Texas, being a candidate for the office of __________,
4143 swear that I will support and defend the constitution and laws of
4244 the United States and of the State of Texas";
4345 (L) a statement that the candidate is aware of the
4446 nepotism law, Chapter 573, Government Code; and
4547 (M) a public mailing address at which the candidate
4648 receives correspondence relating to the candidate's campaign, if
4749 available, and an electronic mail address at which the candidate
4850 receives correspondence relating to the candidate's campaign, if
4951 available.
5052 (N) whether the candidate has any citizenship of any
5153 nation except the United States or a federally recognized Indian
5254 tribe. The question must also require the candidate to list their
5355 other nation or nations of citizenship, as applicable.
5456 (O) The information required in subsection (4)(N) must
5557 be posted online in a publicly available place by the secretary of
5658 state.
5759 SECTION 2. This Act applies only to a candidate in an
5860 election held on or after the effective date of this Act.
5961 SECTION 3. This Act takes effect September 1, 2025.
