| 9 | 9 | | relating to requiring parental consent for behavioral or mental |

| 10 | 10 | | health treatment by school district personnel. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 26.009(a), Education Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) An employee of a school district must obtain the written |
|---|
| 15 | 15 | | consent of a child's parent before the employee may: |
|---|
| 16 | 16 | | (1) conduct a psychological examination, test, or |
|---|
| 17 | 17 | | treatment, unless the examination, test, or treatment is required |
|---|
| 18 | 18 | | under Section 38.004 or state or federal law regarding requirements |
|---|
| 19 | 19 | | for special education; [or] |
|---|
| 20 | 20 | | (2) make or authorize the making of a videotape of a |
|---|
| 21 | 21 | | child or record or authorize the recording of a child's voice; or |
|---|
| 22 | 22 | | (3) provide a child with behavioral or mental health |
|---|
| 23 | 23 | | services or treatment, including: |
|---|
| 24 | 24 | | (A) contraceptives, including emergency |
|---|
| 25 | 25 | | contraceptives; and |
|---|
| 26 | 26 | | (B) informational materials on: |
|---|
| 27 | 27 | | (i) family planning; |
|---|
| 28 | 28 | | (ii) human sexuality; or |
|---|
| 29 | 29 | | (iii) mental health. |
|---|
| 30 | 30 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 31 | 31 | | school year. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2025. |
