77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring parental consent for behavioral or mental
1010 health treatment by school district personnel.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 26.009(a), Education Code, is amended to
1313 read as follows:
1414 (a) An employee of a school district must obtain the written
1515 consent of a child's parent before the employee may:
1616 (1) conduct a psychological examination, test, or
1717 treatment, unless the examination, test, or treatment is required
1818 under Section 38.004 or state or federal law regarding requirements
1919 for special education; [or]
2020 (2) make or authorize the making of a videotape of a
2121 child or record or authorize the recording of a child's voice; or
2222 (3) provide a child with behavioral or mental health
2323 services or treatment, including:
2424 (A) contraceptives, including emergency
2525 contraceptives; and
2626 (B) informational materials on:
2727 (i) family planning;
2828 (ii) human sexuality; or
2929 (iii) mental health.
3030 SECTION 2. This Act applies beginning with the 2025-2026
3131 school year.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2025.
