| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 33, Human Resources Code, |
|---|
| 14 | 14 | | is amended by adding Section 33.031 to read as follows: |
|---|
| 15 | 15 | | Sec. 33.031. PURCHASE OF FOOD AND DRINK ITEMS CONTAINING |
|---|
| 16 | 16 | | CERTAIN FOOD ADDITIVES PROHIBITED UNDER SUPPLEMENTAL NUTRITION |
|---|
| 17 | 17 | | ASSISTANCE PROGRAM. Except as expressly required by federal law, a |
|---|
| 18 | 18 | | recipient of supplemental nutrition assistance program benefits |
|---|
| 19 | 19 | | may not use those benefits to purchase any food or drink item that |
|---|
| 20 | 20 | | contains the following substances: |
|---|
| 21 | 21 | | (1) brominated vegetable oil (BVO); |
|---|
| 22 | 22 | | (2) potassium bromate; |
|---|
| 23 | 23 | | (3) propylparaben; |
|---|
| 24 | 24 | | (4) azodicarbonamide; |
|---|
| 25 | 25 | | (5) butylated hydroxyanisole (BHA); |
|---|
| 26 | 26 | | (6) red dye 3; or |
|---|
| 27 | 27 | | (7) titanium dioxide. |
|---|
| 28 | 28 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 29 | 29 | | a state agency determines that a waiver or authorization from a |
|---|
| 30 | 30 | | federal agency is necessary for implementation of that provision, |
|---|
| 31 | 31 | | the agency affected by the provision shall request the waiver or |
|---|
| 32 | 32 | | authorization and may delay implementing that provision until the |
|---|
| 33 | 33 | | waiver or authorization is granted. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2025. |
