77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting the purchase of food or drink items
1010 containing certain food additives under the supplemental nutrition
1111 assistance program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1414 is amended by adding Section 33.031 to read as follows:
1515 Sec. 33.031. PURCHASE OF FOOD AND DRINK ITEMS CONTAINING
1616 CERTAIN FOOD ADDITIVES PROHIBITED UNDER SUPPLEMENTAL NUTRITION
1717 ASSISTANCE PROGRAM. Except as expressly required by federal law, a
1818 recipient of supplemental nutrition assistance program benefits
1919 may not use those benefits to purchase any food or drink item that
2020 contains the following substances:
2121 (1) brominated vegetable oil (BVO);
2222 (2) potassium bromate;
2323 (3) propylparaben;
2424 (4) azodicarbonamide;
2525 (5) butylated hydroxyanisole (BHA);
2626 (6) red dye 3; or
2727 (7) titanium dioxide.
2828 SECTION 2. If before implementing any provision of this Act
2929 a state agency determines that a waiver or authorization from a
3030 federal agency is necessary for implementation of that provision,
3131 the agency affected by the provision shall request the waiver or
3232 authorization and may delay implementing that provision until the
3333 waiver or authorization is granted.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
