| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 53.003(e), Property Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (e) In determining the deadline or computing the period of |
|---|
| 15 | 15 | | days in which to provide a notice or to take any action required |
|---|
| 16 | 16 | | under this chapter, if the deadline or the last day of the period is |
|---|
| 17 | 17 | | a Saturday, Sunday, or legal holiday, the period is extended to |
|---|
| 18 | 18 | | include the next day that is not a Saturday, Sunday, or legal |
|---|
| 19 | 19 | | holiday. |

| 20 | 20 | | SECTION 2. Section 53.124(e), Property Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | (e) The time of inception of a lien that is created under |
|---|
| 23 | 23 | | Section 53.021(3), (4), or (5) [53.021(c), (d), or (e)] is the date |
|---|
| 24 | 24 | | of recording of an affidavit of lien under Section 53.052. The |
|---|
| 25 | 25 | | priority of a lien claimed by a person entitled to a lien under |
|---|
| 26 | 26 | | Section 53.021(3), (4), or (5) [53.021(c), (d), or (e)] with |
|---|
| 27 | 27 | | respect to other mechanic's liens is determined by the date of |
|---|
| 28 | 28 | | recording. A lien created under Section 53.021(3), (4), or (5) |
|---|
| 29 | 29 | | [53.021(c), (d), or (e)] is not valid or enforceable against a |
|---|
| 30 | 30 | | grantee or purchaser who acquires an interest in the real property |
|---|
| 31 | 31 | | before the time of inception of the lien. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2025. |
