77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the improvement of health, fitness, and readiness of
1010 the Texas military forces.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. This Act may be cited as the Texas Military
1313 Forces Health and Readiness Act.
1414 SECTION 2. Chapter 437, Government Code, is amended by
1515 adding Subchapter J to read as follows:
1616 SUBCHAPTER J. HEALTH AND READINESS
1717 Sec. 437.451. FITNESS STANDARDS. (a) The department shall
1818 establish and post on the department's Internet website baseline
1919 fitness standards aligned with fitness requirements of the United
2020 States armed forces and the specific operational needs of this
2121 state in order to ensure clear performance expectations for service
2222 members.
2323 (b) To assist service members in meeting the fitness
2424 standards established under Subsection (a), the department shall:
2525 (1) develop partnerships with fitness facilities in
2626 this state to provide gym memberships for service members;
2727 (2) ensure access to certified fitness professionals
2828 and training specialists to support service members in meeting the
2929 fitness standards; and
3030 (3) establish fitness centers for service members with
3131 specialized equipment and training programs to support mission
3232 readiness.
3333 Sec. 437.452. DIGITAL HEALTH INTEGRATION PLATFORM. The
3434 department shall develop and implement a digital fitness platform
3535 for service members. The platform must:
3636 (1) provide real-time health monitoring, personalized
3737 training plans, and performance tracking;
3838 (2) include injury prevention guidance, early
3939 intervention protocols, and mental resilience tools; and
4040 (3) ensure secure data integration with existing
4141 department health systems.
4242 Sec. 437.453. COMPREHENSIVE WELLNESS SUPPORT PROGRAM. The
4343 department shall establish an integrated health and resilience
4444 program to provide professional injury rehabilitation services,
4545 mental health support, and dietary counseling to service members.
4646 The program must include:
4747 (1) enhanced meal plans in dining facilities, access
4848 to meal preparation services, and nutrition education tailored to
4949 performance goals;
5050 (2) if covered by gifts, grants, or donations, family
5151 and spousal fitness benefits, including gym memberships,
5252 resilience training, and wellness workshops; and
5353 (3) unit-based counseling, confidential crisis
5454 intervention services for at-risk personnel, and stress management
5555 and resilience training as part of a holistic wellness approach.
5656 Sec. 437.454. PERFORMANCE RECOGNITION FRAMEWORK. The
5757 department shall implement an annual fitness excellence program
5858 that:
5959 (1) provides awards for superior fitness
6060 achievements;
6161 (2) offers career advancement opportunities in
6262 recognition of superior fitness achievements of service members,
6363 including specialized training and leadership development; and
6464 (3) recognizes individual and unit-level achievement
6565 through ceremonies and public events.
6666 Sec. 437.455. ACCOUNTABILITY AND REPORTING REQUIREMENTS.
6767 (a) The department shall submit quarterly reports to the
6868 legislature regarding the activities of the department under this
6969 subchapter. The reports must include:
7070 (1) the participation rates of service members;
7171 (2) aggregated information on changes in service
7272 members' fitness and health indicators;
7373 (3) the overall impact of the activities on service
7474 member readiness and deployment;
7575 (4) cost-benefit analyses and return-on-investment
7676 calculations; and
7777 (5) recommendations for optimization and expansion of
7878 activities to ensure continued effectiveness and sustainability.
7979 (b) The department shall implement corrective action plans
8080 if a report indicates a decline in fitness readiness rates. Any
8181 corrective action must be implemented not later than the 10th day
8282 after the date the report is published.
8383 (c) The department shall:
8484 (1) assign fitness and wellness officers to each unit
8585 to monitor compliance with goals; and
8686 (2) establish fitness mentorship programs, pairing
8787 high-performing members with members who are struggling to meet
8888 readiness standards.
8989 Sec. 437.456. FUNDING; AGREEMENTS WITH PRIVATE ENTITIES.
9090 (a) The department may implement this subchapter using any funds
9191 available to the department for that purpose, including:
9292 (1) money appropriated to the department; and
9393 (2) federal grant funding.
9494 (b) The department may enter into an agreement with a
9595 private entity located in this state that provides fitness, health,
9696 or nutrition services in order to implement this subchapter.
9797 SECTION 3. This Act takes effect immediately if it receives
9898 a vote of two-thirds of all the members elected to each house, as
9999 provided by Section 39, Article III, Texas Constitution. If this
100100 Act does not receive the vote necessary for immediate effect, this
101101 Act takes effect September 1, 2025.
