77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to recommendations for the appointment of directors of the
1010 San Jacinto River Authority.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 6, Chapter 426, Acts of the 45th
1313 Legislature, Regular Session, 1937, is amended to read as follows:
1414 Sec. 6. (a) The management and control of all the affairs of
1515 said District shall be vested in, and the powers, rights,
1616 privileges, and functions of the District shall be exercised by, a
1717 Board of Directors consisting of seven members, all of whom shall be
1818 freehold property taxpayers and legal voters of the State of Texas
1919 and four (4) of whom shall be residents of a county wholly
2020 encompassed by the District. Members of such Board of Directors
2121 shall be appointed by the Governor for terms of four years.
2222 (b) A commissioners court of a county wholly located in the
2323 district may make two recommendations to the governor for the
2424 appointment of a person to the board of directors of the authority.
2525 A commissioners court of a county partially located in the district
2626 may make one recommendation to the governor for the appointment of a
2727 person to the board of directors of the authority. The
2828 commissioners court of the county making a recommendation under
2929 this subsection must approve each recommendation by a majority
3030 vote. After reviewing the recommendations, the governor may
3131 appoint or not appoint the person recommended by the commissioners
3232 court.
3333 (c) The Directors shall hold office after their appointment
3434 and qualification until their successors shall be appointed and
3535 qualified. Should any vacancy occur in the Board of Directors, the
3636 same shall be filled in like manner by the Governor for the
3737 unexpired term. The Directors appointed shall, within thirty (30)
3838 days after their appointment, qualify by taking the official oath
3939 required of County Commissioners, and shall execute bond in the sum
4040 of Five Thousand Dollars ($5,000) payable to the District, the
4141 sufficiency of which bond shall be determined by the Governor,
4242 which bonds after being recorded in the official bond records of the
4343 county in which the District maintains its office shall be
4444 deposited with the depository selected and approved for the deposit
4545 of the funds of the District.
4646 (d) The Governor shall designate a Director as the President
4747 of the Board to serve in that capacity at the pleasure of the
4848 Governor. The Board of Directors shall organize by electing one of
4949 its members Vice-President, one Secretary, and one Treasurer. Four
5050 (4) members, including the President, shall constitute a quorum to
5151 transact business. The President shall preside at all meetings of
5252 the Board and shall be the chief executive officer of the District.
5353 The Vice-President shall act as President in case of the absence or
5454 disability of the President. The Secretary shall act as Secretary
5555 of the Board and shall be charged with the duty of keeping a record
5656 of all proceedings and all orders of the Board. The Treasurer shall
5757 receive and receipt for all moneys received by the District and
5858 shall keep books and records of all moneys received and expended.
5959 In case of the absence or inability of the Secretary to act, a
6060 Secretary pro tem shall be selected by the Directors.
6161 (e) The domicile of the District shall be in the City of
6262 Conroe, in the County of Montgomery, Texas, where the District
6363 shall maintain its principal office. The Board of Directors shall
6464 have authority to fix the time, place and number of meetings of such
6565 Board by proper resolutions, regulations and bylaws passed by said
6666 Board. Said Board shall cause to be kept complete and accurate
6767 accounts conforming to approved methods of bookkeeping. Said
6868 accounts and all contracts, documents, and records of the District
6969 shall be kept at said principal office, and same shall be open to
7070 public inspection at all reasonable times.
7171 SECTION 2. This Act takes effect September 1, 2025.
