9 | 9 | | relating to recommendations for the appointment of directors of the |

10 | 10 | | San Jacinto River Authority. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 6, Chapter 426, Acts of the 45th |
---|
13 | 13 | | Legislature, Regular Session, 1937, is amended to read as follows: |
---|
14 | 14 | | Sec. 6. (a) The management and control of all the affairs of |
---|
15 | 15 | | said District shall be vested in, and the powers, rights, |
---|
16 | 16 | | privileges, and functions of the District shall be exercised by, a |
---|
17 | 17 | | Board of Directors consisting of seven members, all of whom shall be |
---|
18 | 18 | | freehold property taxpayers and legal voters of the State of Texas |
---|
19 | 19 | | and four (4) of whom shall be residents of a county wholly |
---|
20 | 20 | | encompassed by the District. Members of such Board of Directors |
---|
21 | 21 | | shall be appointed by the Governor for terms of four years. |
---|
22 | 22 | | (b) A commissioners court of a county wholly located in the |
---|
23 | 23 | | district may make two recommendations to the governor for the |
---|
24 | 24 | | appointment of a person to the board of directors of the authority. |
---|
25 | 25 | | A commissioners court of a county partially located in the district |
---|
26 | 26 | | may make one recommendation to the governor for the appointment of a |
---|
27 | 27 | | person to the board of directors of the authority. The |
---|
28 | 28 | | commissioners court of the county making a recommendation under |
---|
29 | 29 | | this subsection must approve each recommendation by a majority |
---|
30 | 30 | | vote. After reviewing the recommendations, the governor may |
---|
31 | 31 | | appoint or not appoint the person recommended by the commissioners |
---|
32 | 32 | | court. |
---|
33 | 33 | | (c) The Directors shall hold office after their appointment |
---|
34 | 34 | | and qualification until their successors shall be appointed and |
---|
35 | 35 | | qualified. Should any vacancy occur in the Board of Directors, the |
---|
36 | 36 | | same shall be filled in like manner by the Governor for the |
---|
37 | 37 | | unexpired term. The Directors appointed shall, within thirty (30) |
---|
38 | 38 | | days after their appointment, qualify by taking the official oath |
---|
39 | 39 | | required of County Commissioners, and shall execute bond in the sum |
---|
40 | 40 | | of Five Thousand Dollars ($5,000) payable to the District, the |
---|
41 | 41 | | sufficiency of which bond shall be determined by the Governor, |
---|
42 | 42 | | which bonds after being recorded in the official bond records of the |
---|
43 | 43 | | county in which the District maintains its office shall be |
---|
44 | 44 | | deposited with the depository selected and approved for the deposit |
---|
45 | 45 | | of the funds of the District. |
---|
46 | 46 | | (d) The Governor shall designate a Director as the President |
---|
47 | 47 | | of the Board to serve in that capacity at the pleasure of the |
---|
48 | 48 | | Governor. The Board of Directors shall organize by electing one of |
---|
49 | 49 | | its members Vice-President, one Secretary, and one Treasurer. Four |
---|
50 | 50 | | (4) members, including the President, shall constitute a quorum to |
---|
51 | 51 | | transact business. The President shall preside at all meetings of |
---|
52 | 52 | | the Board and shall be the chief executive officer of the District. |
---|
53 | 53 | | The Vice-President shall act as President in case of the absence or |
---|
54 | 54 | | disability of the President. The Secretary shall act as Secretary |
---|
55 | 55 | | of the Board and shall be charged with the duty of keeping a record |
---|
56 | 56 | | of all proceedings and all orders of the Board. The Treasurer shall |
---|
57 | 57 | | receive and receipt for all moneys received by the District and |
---|
58 | 58 | | shall keep books and records of all moneys received and expended. |
---|
59 | 59 | | In case of the absence or inability of the Secretary to act, a |
---|
60 | 60 | | Secretary pro tem shall be selected by the Directors. |
---|
61 | 61 | | (e) The domicile of the District shall be in the City of |
---|
62 | 62 | | Conroe, in the County of Montgomery, Texas, where the District |
---|
63 | 63 | | shall maintain its principal office. The Board of Directors shall |
---|
64 | 64 | | have authority to fix the time, place and number of meetings of such |
---|
65 | 65 | | Board by proper resolutions, regulations and bylaws passed by said |
---|
66 | 66 | | Board. Said Board shall cause to be kept complete and accurate |
---|
67 | 67 | | accounts conforming to approved methods of bookkeeping. Said |
---|
68 | 68 | | accounts and all contracts, documents, and records of the District |
---|
69 | 69 | | shall be kept at said principal office, and same shall be open to |
---|
70 | 70 | | public inspection at all reasonable times. |
---|
71 | 71 | | SECTION 2. This Act takes effect September 1, 2025. |
