77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the use of the skills development fund by certain
1010 entities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 303.001(a), Labor Code, is amended to
1313 read as follows:
1414 (a) The purpose of this chapter is to remove administrative
1515 barriers that impede the response of public community and technical
1616 colleges, community-based organizations, local workforce
1717 development boards, the Texas A&M Engineering Experiment Station,
1818 and the Texas A&M Engineering Extension Service to industry and
1919 workforce training needs and to develop incentives for public
2020 community and technical colleges, community-based organizations,
2121 local workforce development boards, the Texas A&M Engineering
2222 Experiment Station, and the Texas A&M Engineering Extension Service
2323 to provide customized assessment and training in a timely and
2424 efficient manner.
2525 SECTION 2. Section 303.002(b), Labor Code, is amended to
2626 read as follows:
2727 (b) A public community or technical college, the Texas A&M
2828 Engineering Experiment Station, or the Texas A&M Engineering
2929 Extension Service may recover customized assessment and training
3030 costs incurred by the college, station, or service [institution]
3131 if:
3232 (1) there is an actual or projected labor shortage in
3333 the occupation in which training is provided that is not being met
3434 by an existing institution or program in the area; and
3535 (2) the wages at the time of job placement for
3636 individuals who successfully complete customized training at the
3737 public community or technical college, the Texas A&M Engineering
3838 Experiment Station, or the Texas A&M Engineering Extension Service
3939 are equal to the prevailing wage for that occupation in the local
4040 labor market area.
4141 SECTION 3. Sections 303.003(b), (f), (g), and (h), Labor
4242 Code, are amended to read as follows:
4343 (b) The skills development fund may be used by public
4444 community and technical colleges, community-based organizations,
4545 local workforce development boards, the Texas A&M Engineering
4646 Experiment Station, and the Texas A&M Engineering Extension Service
4747 as start-up or emergency funds for the following job-training
4848 purposes:
4949 (1) developing customized training programs for
5050 businesses and trade unions; and
5151 (2) sponsoring small and medium-sized business
5252 networks and consortiums.
5353 (f) The Texas A&M Engineering Experiment Station and the
5454 Texas A&M Engineering Extension Service shall focus the station's
5555 or service's training activities under this chapter on programs
5656 that:
5757 (1) are statewide in nature; or
5858 (2) are not available from a local junior college
5959 district, a local technical college, or a consortium of junior
6060 college districts.
6161 (g) This section does not prohibit the Texas A&M Engineering
6262 Experiment Station or the Texas A&M Engineering Extension Service
6363 from participating in a consortium of junior college districts or
6464 with a technical college that provides training under this chapter.
6565 (h) A community-based organization may apply for money to
6666 participate in a training program only in partnership with a
6767 community and technical college, the Texas A&M Engineering
6868 Experiment Station, or the Texas A&M Engineering Extension Service.
6969 A community-based organization providing services regulated by the
7070 state shall provide evidence of any certification, license, or
7171 registration required by law.
7272 SECTION 4. Section 303.004, Labor Code, is amended to read
7373 as follows:
7474 Sec. 303.004. FUND REVIEW; REPORT BY CERTAIN WORKFORCE
7575 TRAINING PROVIDERS REQUIRED. (a) The Texas Higher Education
7676 Coordinating Board shall review all customized training programs
7777 biennially to verify that state funds are being used appropriately
7878 by public community and technical colleges, the Texas A&M
7979 Engineering Experiment Station, and the Texas A&M Engineering
8080 Extension Service under this chapter.
8181 (b) Not later than October 1 of each even-numbered year, the
8282 Texas A&M Engineering Experiment Station, the Texas A&M Engineering
8383 Extension Service, and each public community or technical college
8484 that provides workforce training under this chapter shall:
8585 (1) conduct a review of the station's, service's, or
8686 college's training programs to:
8787 (A) determine the effectiveness of the programs
8888 in improving the wages of participants who complete the programs;
8989 and
9090 (B) identify strategies for improving the
9191 delivery of workforce training in order to more effectively impact
9292 economic development in this state; and
9393 (2) submit to the commission a detailed written report
9494 summarizing the results of the review for inclusion by the
9595 executive director in the report to the governor and the
9696 legislature required by Section 303.006(c).
9797 (c) If the Texas A&M Engineering Experiment Station, the
9898 Texas A&M Engineering Extension Service, or a public community or
9999 technical college fails to submit a report required by Subsection
100100 (b)(2):
101101 (1) the station, service, or college must refund to
102102 the comptroller any unexpended state funds received by the station,
103103 service, or college under this chapter for the state fiscal
104104 biennium in which the report was due; and
105105 (2) the commission may not award any additional grant
106106 to the station, service, or college under this chapter until the
107107 station, service, or college has complied with that reporting
108108 requirement.
109109 SECTION 5. This Act takes effect September 1, 2025.
