| 9 | 9 | | relating to the memorial designation of certain portions of an |

| 10 | 10 | | international border wall and the use of grants related to homeland |
|---|
| 11 | 11 | | security for those purposes. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 421.072, Government Code, is amended by |
|---|
| 14 | 14 | | adding Subsection (d) to read as follows: |
|---|
| 15 | 15 | | (d) The governor may allocate available federal and state |
|---|
| 16 | 16 | | grants and other funding related to homeland security to the Texas |
|---|
| 17 | 17 | | Facilities Commission for expenses incurred by the commission in |
|---|
| 18 | 18 | | designing, constructing, and maintaining memorial markers under |
|---|
| 19 | 19 | | Subchapter D, Chapter 2152. |
|---|
| 20 | 20 | | SECTION 2. Chapter 2152, Government Code, is amended by |
|---|
| 21 | 21 | | adding Subchapter D to read as follows: |
|---|
| 22 | 22 | | SUBCHAPTER D. NAMING OF INTERNATIONAL BORDER WALL |
|---|
| 23 | 23 | | Sec. 2152.151. DEFINITION. In this subchapter, "alien" has |
|---|
| 24 | 24 | | the meaning assigned by Section 51.01, Penal Code. |
|---|
| 25 | 25 | | Sec. 2152.152. APPLICABILITY OF SUBCHAPTER. This |
|---|
| 26 | 26 | | subchapter applies only to a border wall constructed by this state |
|---|
| 27 | 27 | | on land owned by this state on its international border with the |
|---|
| 28 | 28 | | United Mexican States. |
|---|
| 29 | 29 | | Sec. 2152.153. RESTRICTIONS ON NAMING BORDER WALL. (a) |
|---|
| 30 | 30 | | Except as otherwise provided by statute, a part of a border wall may |
|---|
| 31 | 31 | | not be designated by a name. |
|---|
| 32 | 32 | | (b) A part of a border wall may be designated by the name of |
|---|
| 33 | 33 | | a person only if the person is deceased and was a victim of a crime, |
|---|
| 34 | 34 | | including a border-related crime, committed by a person who is an |
|---|
| 35 | 35 | | alien. |
|---|
| 36 | 36 | | Sec. 2152.154. MEMORIAL MARKERS FOR NAMED PART OF BORDER |
|---|
| 37 | 37 | | WALL. (a) The commission shall erect each memorial marker required |
|---|
| 38 | 38 | | by this subchapter. |
|---|
| 39 | 39 | | (b) Notwithstanding Subsection (a), the commission may not |
|---|
| 40 | 40 | | design, construct, or erect a memorial marker unless a gift, grant, |
|---|
| 41 | 41 | | or donation of funds is made to the commission to cover the cost of |
|---|
| 42 | 42 | | the design, construction, and erection of the marker. |
|---|
| 43 | 43 | | (c) The commission shall repair and replace each memorial |
|---|
| 44 | 44 | | marker required by this subchapter and maintain the grounds for the |
|---|
| 45 | 45 | | marker. |
|---|
| 46 | 46 | | (d) The commission may accept a gift, grant, or donation |
|---|
| 47 | 47 | | from any public or private source made to assist in financing the |
|---|
| 48 | 48 | | construction and maintenance of a memorial marker. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect September 1, 2025. |
