77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the memorial designation of certain portions of an
1010 international border wall and the use of grants related to homeland
1111 security for those purposes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 421.072, Government Code, is amended by
1414 adding Subsection (d) to read as follows:
1515 (d) The governor may allocate available federal and state
1616 grants and other funding related to homeland security to the Texas
1717 Facilities Commission for expenses incurred by the commission in
1818 designing, constructing, and maintaining memorial markers under
1919 Subchapter D, Chapter 2152.
2020 SECTION 2. Chapter 2152, Government Code, is amended by
2121 adding Subchapter D to read as follows:
2222 SUBCHAPTER D. NAMING OF INTERNATIONAL BORDER WALL
2323 Sec. 2152.151. DEFINITION. In this subchapter, "alien" has
2424 the meaning assigned by Section 51.01, Penal Code.
2525 Sec. 2152.152. APPLICABILITY OF SUBCHAPTER. This
2626 subchapter applies only to a border wall constructed by this state
2727 on land owned by this state on its international border with the
2828 United Mexican States.
2929 Sec. 2152.153. RESTRICTIONS ON NAMING BORDER WALL. (a)
3030 Except as otherwise provided by statute, a part of a border wall may
3131 not be designated by a name.
3232 (b) A part of a border wall may be designated by the name of
3333 a person only if the person is deceased and was a victim of a crime,
3434 including a border-related crime, committed by a person who is an
3535 alien.
3636 Sec. 2152.154. MEMORIAL MARKERS FOR NAMED PART OF BORDER
3737 WALL. (a) The commission shall erect each memorial marker required
3838 by this subchapter.
3939 (b) Notwithstanding Subsection (a), the commission may not
4040 design, construct, or erect a memorial marker unless a gift, grant,
4141 or donation of funds is made to the commission to cover the cost of
4242 the design, construction, and erection of the marker.
4343 (c) The commission shall repair and replace each memorial
4444 marker required by this subchapter and maintain the grounds for the
4545 marker.
4646 (d) The commission may accept a gift, grant, or donation
4747 from any public or private source made to assist in financing the
4848 construction and maintenance of a memorial marker.
4949 SECTION 3. This Act takes effect September 1, 2025.
