77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the standards for public school library materials.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 33.021(d), Education Code, is amended to
1212 read as follows:
1313 (d) The standards adopted under Subsection (c) must:
1414 (1) be reviewed and updated at least once every five
1515 years; and
1616 (2) include a collection development policy that:
1717 (A) prohibits the possession, acquisition, and
1818 purchase of:
1919 (i) harmful material, as defined by Section
2020 43.24, Penal Code;
2121 (ii) library material rated sexually
2222 explicit material by the selling library material vendor; [or]
2323 (iii) library material that is pervasively
2424 vulgar or educationally unsuitable as referenced in Pico v. Board
2525 of Education, 457 U.S. 853 (1982); or
2626 (iv) library material included on the list
2727 maintained by the Texas Department of Criminal Justice of
2828 publications an inmate may not receive in a correctional facility;
2929 (B) recognizes that obscene content is not
3030 protected by the First Amendment to the United States Constitution;
3131 (C) is required for all library materials
3232 available for use or display, including material contained in
3333 school libraries, classroom libraries, and online catalogs;
3434 (D) recognizes that parents are the primary
3535 decision makers regarding a student's access to library material;
3636 (E) encourages schools to provide library
3737 catalog transparency;
3838 (F) recommends schools communicate effectively
3939 with parents regarding collection development; and
4040 (G) prohibits the removal of material based
4141 solely on the:
4242 (i) ideas contained in the material; or
4343 (ii) personal background of:
4444 (a) the author of the material; or
4545 (b) characters in the material.
4646 SECTION 2. This Act applies beginning with the 2025-2026
4747 school year.
4848 SECTION 3. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2025.
