77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation of cigarettes and tobacco products,
1010 including the definitions of cigarettes and tobacco products.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. This Act may be cited as the Nicotine Access
1313 Protection Act.
1414 SECTION 2. Sections 161.081(1) and (5), Health and Safety
1515 Code, are amended to read as follows:
1616 (1) "Cigarette" means any product intended to be
1717 burned or heated under ordinary conditions of use and consisting of
1818 or containing:
1919 (A) a roll of tobacco, herbs, or hemp wrapped in
2020 paper or another substance that does not contain tobacco;
2121 (B) any form of tobacco, herbs, or hemp used as a
2222 filler in a product that, because of the product's appearance, the
2323 type of tobacco, herbs, or hemp used as the filler, or the product's
2424 packaging and labeling, is likely to be offered to or purchased by a
2525 consumer as a cigarette; or
2626 (C) a roll of tobacco, herbs, or hemp wrapped in
2727 any substance containing tobacco that, because of the product's
2828 appearance, the type of tobacco, herbs, or hemp used as the filler,
2929 or the product's packaging and labeling, is likely to be offered to
3030 or purchased by a consumer as a cigarette [has the meaning assigned
3131 by Section 154.001, Tax Code].
3232 (5) "Tobacco product" means any product made of or
3333 derived from tobacco or containing nicotine, including
3434 synthetically derived nicotine, that is intended for human
3535 consumption. The term includes any component, part, or accessory
3636 of the product. The term does not include raw materials, other than
3737 tobacco, used in the manufacturing of a component, part, or
3838 accessory of a tobacco product [has the meaning assigned by Section
3939 155.001, Tax Code].
4040 SECTION 3. Section 161.0815, Health and Safety Code, is
4141 amended to read as follows:
4242 Sec. 161.0815. NONAPPLICABILITY. This subchapter does not
4343 apply to a product:
4444 (1) that is:
4545 (A) [(1)] approved by the United States Food and
4646 Drug Administration for use in the treatment of nicotine or smoking
4747 addiction; and
4848 (B) [(2)] labeled with a "Drug Facts" panel in
4949 accordance with regulations of the United States Food and Drug
5050 Administration; or
5151 (2) that does not contain nicotine or contains only
5252 trace amounts of naturally occurring nicotine and constitutes:
5353 (A) a food as defined by Section 201(f), Federal
5454 Food, Drug, and Cosmetic Act (21 U.S.C. 321(f));
5555 (B) a drug as defined by Section 201(g)(1),
5656 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321(g)(1));
5757 (C) a device as defined by Section 201(h)(1),
5858 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321(h)(1)); or
5959 (D) a combination product regulated under
6060 Section 503(g) of the Federal Food, Drug, and Cosmetic Act (21
6161 U.S.C. 353(g)).
6262 SECTION 4. Sections 161.121(2) and (5), Health and Safety
6363 Code, are amended to read as follows:
6464 (2) "Cigarette" has the meaning assigned by Section
6565 161.081 [154.001, Tax Code].
6666 (5) "Tobacco product" has the meaning assigned by
6767 Section 161.081 [155.001, Tax Code].
6868 SECTION 5. Sections 161.251(1) and (2), Health and Safety
6969 Code, are amended to read as follows:
7070 (1) "Cigarette" has the meaning assigned by Section
7171 161.081 [154.001, Tax Code].
7272 (2) "Tobacco product" has the meaning assigned by
7373 Section 161.081 [155.001, Tax Code].
7474 SECTION 6. Sections 161.351(1) and (3), Health and Safety
7575 Code, are amended to read as follows:
7676 (1) "Cigarette" has the meaning assigned by Section
7777 161.081 [154.001, Tax Code].
7878 (3) "Tobacco product" has the meaning assigned by
7979 Section 161.081 [155.001, Tax Code].
8080 SECTION 7. This Act takes effect September 1, 2025.
