88 AN ACT
99 relating to elimination of the motor vehicle emissions inspection
1010 and maintenance program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter G, Chapter 382, Health and Safety
1313 Code, is amended by adding Section 382.2025 to read as follows:
1414 Sec. 382.2025. ELIMINATION OF PROGRAM. Notwithstanding any
1515 other law, the commission and the Department of Public Safety may
1616 not implement or enforce any other provision of this subchapter or a
1717 requirement under Chapter 548, Transportation Code, related to
1818 emissions inspections.
1919 SECTION 2. (a) Except as otherwise provided by this
2020 section, this Act takes effect September 1, 2025.
2121 (b) Section 1 of this Act takes effect on the 30th day after
2222 the date:
2323 (1) the United States Congress enacts legislation that
2424 becomes law that repeals the federal Clean Air Act (42 U.S.C.
2525 Section 7401 et seq.) or amends it in a way that the motor vehicle
2626 emissions inspection and maintenance program established under
2727 Subchapter G, Chapter 382, Health and Safety Code, is no longer
2828 required;
2929 (2) of the issuance of a United States Supreme Court
3030 judgment that recognizes the authority of the states to prohibit
3131 vehicle emissions inspection and maintenance programs; or
3232 (3) of the adoption of an amendment to the United
3333 States Constitution giving states the authority to prohibit vehicle
3434 emissions inspection and maintenance programs.
3535 (c) If an action described by Subsection (b) of this section
3636 does not occur, Section 1 of this Act has no effect.
