| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter G, Chapter 382, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 382.2025 to read as follows: |
|---|
| 14 | 14 | | Sec. 382.2025. ELIMINATION OF PROGRAM. Notwithstanding any |
|---|
| 15 | 15 | | other law, the commission and the Department of Public Safety may |
|---|
| 16 | 16 | | not implement or enforce any other provision of this subchapter or a |
|---|
| 17 | 17 | | requirement under Chapter 548, Transportation Code, related to |
|---|
| 18 | 18 | | emissions inspections. |
|---|
| 19 | 19 | | SECTION 2. (a) Except as otherwise provided by this |
|---|
| 20 | 20 | | section, this Act takes effect September 1, 2025. |
|---|
| 21 | 21 | | (b) Section 1 of this Act takes effect on the 30th day after |
|---|
| 22 | 22 | | the date: |
|---|
| 23 | 23 | | (1) the United States Congress enacts legislation that |
|---|
| 24 | 24 | | becomes law that repeals the federal Clean Air Act (42 U.S.C. |
|---|
| 25 | 25 | | Section 7401 et seq.) or amends it in a way that the motor vehicle |
|---|
| 26 | 26 | | emissions inspection and maintenance program established under |
|---|
| 27 | 27 | | Subchapter G, Chapter 382, Health and Safety Code, is no longer |
|---|
| 28 | 28 | | required; |
|---|
| 29 | 29 | | (2) of the issuance of a United States Supreme Court |
|---|
| 30 | 30 | | judgment that recognizes the authority of the states to prohibit |
|---|
| 31 | 31 | | vehicle emissions inspection and maintenance programs; or |
|---|
| 32 | 32 | | (3) of the adoption of an amendment to the United |
|---|
| 33 | 33 | | States Constitution giving states the authority to prohibit vehicle |
|---|
| 34 | 34 | | emissions inspection and maintenance programs. |
|---|
| 35 | 35 | | (c) If an action described by Subsection (b) of this section |
|---|
| 36 | 36 | | does not occur, Section 1 of this Act has no effect. |
