| 12 | 12 | SECTION 1. Section 46.04, Penal Code, is amended by adding | |
| 13 | 13 | Subsection (a-2) and amending Subsection (e) to read as follows: | |
| 14 | 14 | (a-2) A person commits an offense if the person is not | |
| 15 | 15 | lawfully present in the United States and possesses a firearm. | |
| 16 | 16 | (e) An offense under Subsection (a) is a felony of the third | |
| 17 | 17 | degree. An offense under Subsection (a-2) is a state jail felony. | |
| 18 | 18 | An offense under Subsection (a-1), (b), or (c) is a Class A | |
| 19 | 19 | misdemeanor. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2025. |
