77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to state preemption of and the effect of certain state
1010 health and safety laws on certain municipal and county regulations,
1111 including a law providing that an elephant is a dangerous wild
1212 animal.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 102A.002, Civil Practice and Remedies
1515 Code, is amended to read as follows:
1616 Sec. 102A.002. LIABILITY FOR CERTAIN REGULATION. Any
1717 person who has sustained an injury in fact, actual or threatened,
1818 from a municipal or county ordinance, order, or rule adopted or
1919 enforced by a municipality or county in violation of any of the
2020 following provisions or a trade association representing the person
2121 has standing to bring and may bring an action against the
2222 municipality or county:
2323 (1) Section 1.004, Agriculture Code;
2424 (2) Section 1.109, Business & Commerce Code;
2525 (3) Section 1.004, Finance Code;
2626 (4) Section 1.006, Health and Safety Code;
2727 (5) Section 30.005, Insurance Code;
2828 (6) [(5)] Section 1.005, Labor Code;
2929 (7) [(6)] Section 229.901, Local Government Code;
3030 (8) [(7)] Section 1.003, Natural Resources Code;
3131 (9) [(8)] Section 1.004, Occupations Code; or
3232 (10) [(9)] Section 1.004, Property Code.
3333 SECTION 2. Chapter 1, Health and Safety Code, is amended by
3434 adding Section 1.006 to read as follows:
3535 Sec. 1.006. PREEMPTION. Unless expressly authorized by
3636 another statute, a municipality or county may not adopt, enforce,
3737 or maintain an ordinance, order, or rule regulating conduct in a
3838 field of regulation that is occupied by a provision of this code. An
3939 ordinance, order, or rule that violates this section is void,
4040 unenforceable, and inconsistent with this code.
4141 SECTION 3. Section 822.101(4), Health and Safety Code, is
4242 amended to read as follows:
4343 (4) "Dangerous wild animal" means:
4444 (A) a lion;
4545 (B) a tiger;
4646 (C) an ocelot;
4747 (D) a cougar;
4848 (E) a leopard;
4949 (F) a cheetah;
5050 (G) a jaguar;
5151 (H) a bobcat;
5252 (I) a lynx;
5353 (J) a serval;
5454 (K) a caracal;
5555 (L) a hyena;
5656 (M) a bear;
5757 (N) a coyote;
5858 (O) a jackal;
5959 (P) a baboon;
6060 (Q) a chimpanzee;
6161 (R) an orangutan;
6262 (S) a gorilla;
6363 (T) an elephant; or
6464 (U) [(T)] any hybrid of an animal listed in this
6565 subdivision.
6666 SECTION 4. Chapter 102A, Civil Practice and Remedies Code,
6767 as amended by this Act, applies only to a cause of action that
6868 accrues on or after the effective date of this Act.
6969 SECTION 5. This Act takes effect September 1, 2025.
