10 | 10 | | health and safety laws on certain municipal and county regulations, |

11 | 11 | | including a law providing that an elephant is a dangerous wild |

13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 102A.002, Civil Practice and Remedies |
---|
15 | 15 | | Code, is amended to read as follows: |
---|
16 | 16 | | Sec. 102A.002. LIABILITY FOR CERTAIN REGULATION. Any |
---|
17 | 17 | | person who has sustained an injury in fact, actual or threatened, |
---|
18 | 18 | | from a municipal or county ordinance, order, or rule adopted or |
---|
19 | 19 | | enforced by a municipality or county in violation of any of the |
---|
20 | 20 | | following provisions or a trade association representing the person |
---|
21 | 21 | | has standing to bring and may bring an action against the |
---|
22 | 22 | | municipality or county: |
---|
23 | 23 | | (1) Section 1.004, Agriculture Code; |
---|
24 | 24 | | (2) Section 1.109, Business & Commerce Code; |
---|
25 | 25 | | (3) Section 1.004, Finance Code; |
---|
26 | 26 | | (4) Section 1.006, Health and Safety Code; |
---|
27 | 27 | | (5) Section 30.005, Insurance Code; |
---|
28 | 28 | | (6) [(5)] Section 1.005, Labor Code; |
---|
29 | 29 | | (7) [(6)] Section 229.901, Local Government Code; |
---|
30 | 30 | | (8) [(7)] Section 1.003, Natural Resources Code; |
---|
31 | 31 | | (9) [(8)] Section 1.004, Occupations Code; or |
---|
32 | 32 | | (10) [(9)] Section 1.004, Property Code. |
---|
33 | 33 | | SECTION 2. Chapter 1, Health and Safety Code, is amended by |
---|
34 | 34 | | adding Section 1.006 to read as follows: |
---|
35 | 35 | | Sec. 1.006. PREEMPTION. Unless expressly authorized by |
---|
36 | 36 | | another statute, a municipality or county may not adopt, enforce, |
---|
37 | 37 | | or maintain an ordinance, order, or rule regulating conduct in a |
---|
38 | 38 | | field of regulation that is occupied by a provision of this code. An |
---|
39 | 39 | | ordinance, order, or rule that violates this section is void, |
---|
40 | 40 | | unenforceable, and inconsistent with this code. |
---|
41 | 41 | | SECTION 3. Section 822.101(4), Health and Safety Code, is |
---|
42 | 42 | | amended to read as follows: |
---|
43 | 43 | | (4) "Dangerous wild animal" means: |
---|
44 | 44 | | (A) a lion; |
---|
45 | 45 | | (B) a tiger; |
---|
46 | 46 | | (C) an ocelot; |
---|
47 | 47 | | (D) a cougar; |
---|
48 | 48 | | (E) a leopard; |
---|
49 | 49 | | (F) a cheetah; |
---|
50 | 50 | | (G) a jaguar; |
---|
51 | 51 | | (H) a bobcat; |
---|
52 | 52 | | (I) a lynx; |
---|
53 | 53 | | (J) a serval; |
---|
54 | 54 | | (K) a caracal; |
---|
55 | 55 | | (L) a hyena; |
---|
56 | 56 | | (M) a bear; |
---|
57 | 57 | | (N) a coyote; |
---|
58 | 58 | | (O) a jackal; |
---|
59 | 59 | | (P) a baboon; |
---|
60 | 60 | | (Q) a chimpanzee; |

68 | 68 | | accrues on or after the effective date of this Act. |

69 | 69 | | SECTION 5. This Act takes effect September 1, 2025. |
