77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring the Texas Commission on Environmental Quality
1010 to study and report about water rights that may be subject to
1111 cancellation for nonuse.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 11.173, Water Code, is amended by adding
1414 Subsections (c) and (c-1) to read as follows:
1515 (c) At least once every five years, the commission shall:
1616 (1) analyze permits, certified filings, and
1717 certificates of adjudication under which all or part of the water
1818 authorized to be appropriated has not been put to beneficial use at
1919 any time during the immediately preceding 10-year period; and
2020 (2) prepare and submit to the board, the Parks and
2121 Wildlife Department, and the Legislative Budget Board a written
2222 report that:
2323 (A) identifies permits, certified filings, and
2424 certificates of adjudication analyzed under Subdivision (1) for
2525 which an exemption from cancellation is provided under Subsection
2626 (b);
2727 (B) identifies permits, certified filings, and
2828 certificates of adjudication analyzed under Subdivision (1) that
2929 may be subject to cancellation under Subsection (a); and
3030 (C) for each permit, filing, or certificate
3131 identified under Paragraph (B), specifies:
3232 (i) the volume of water associated with the
3333 permit, filing, or certificate;
3434 (ii) whether an action for cancellation of
3535 the permit, filing, or certificate has been initiated by the
3636 commission; and
3737 (iii) whether the water associated with the
3838 permit, filing, or certification may be appropriate for dedication
3939 to the Texas Water Trust established under Section 15.7031.
4040 (c-1) The commission shall submit the initial report
4141 required by Subsection (c) not later than December 31, 2026. This
4242 subsection expires September 1, 2027.
4343 SECTION 2. This Act takes effect September 1, 2025.
