77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the employment of and parental notification regarding
1010 classroom teachers in public schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 12A.004(a), Education Code, is amended
1313 to read as follows:
1414 (a) A local innovation plan may not provide for the
1515 exemption of a district designated as a district of innovation from
1616 the following provisions of this title:
1717 (1) a state or federal requirement applicable to an
1818 open-enrollment charter school operating under Subchapter D,
1919 Chapter 12;
2020 (2) Subchapters A, C, D, and E, Chapter 11, except that
2121 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2222 Section 11.162;
2323 (3) employment of uncertified teachers of record under
2424 Section 21.0032;
2525 (4) parental notification requirements under Section
2626 21.057;
2727 (5) state curriculum and graduation requirements
2828 adopted under Chapter 28; and
2929 (6) [(4)] academic and financial accountability and
3030 sanctions under Chapters 39 and 39A.
3131 SECTION 2. Section 21.001, Education Code, is amended by
3232 adding Subdivision (3-b) to read as follows:
3333 (3-b) "Teacher of record" means a person employed by a
3434 school district who teaches the majority of the instructional day
3535 in an academic instructional setting and is responsible for
3636 evaluating student achievement and assigning grades.
3737 SECTION 3. Subchapter A, Chapter 21, Education Code, is
3838 amended by adding Section 21.0032 to read as follows:
3939 Sec. 21.0032. EMPLOYMENT OF CERTAIN UNCERTIFIED CLASSROOM
4040 TEACHERS. A school district may not employ as a classroom teacher a
4141 person who does not hold an appropriate certificate or permit
4242 issued by the State Board for Educator Certification under
4343 Subchapter B as the teacher of record for:
4444 (1) a reading language arts or mathematics course in
4545 kindergarten through grade five;
4646 (2) a mathematics course in grades six through eight;
4747 or
4848 (3) a course or combination of courses that requires
4949 at least two years of relevant coursework or experience for
5050 appropriate certification.
5151 SECTION 4. This Act applies beginning with the 2026-2027
5252 school year.
5353 SECTION 5. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2025.
