| 9 | 9 | | relating to the employment of and parental notification regarding |
|---|
| 10 | 10 | | classroom teachers in public schools. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Section 12A.004(a), Education Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (a) A local innovation plan may not provide for the |
|---|
| 15 | 15 | | exemption of a district designated as a district of innovation from |
|---|
| 16 | 16 | | the following provisions of this title: |
|---|
| 17 | 17 | | (1) a state or federal requirement applicable to an |
|---|
| 18 | 18 | | open-enrollment charter school operating under Subchapter D, |
|---|
| 19 | 19 | | Chapter 12; |
|---|
| 20 | 20 | | (2) Subchapters A, C, D, and E, Chapter 11, except that |
|---|
| 21 | 21 | | a district may be exempt from Sections 11.1511(b)(5) and (14) and |
|---|
| 22 | 22 | | Section 11.162; |
|---|
| 23 | 23 | | (3) employment of uncertified teachers of record under |
|---|
| 24 | 24 | | Section 21.0032; |
|---|
| 25 | 25 | | (4) parental notification requirements under Section |
|---|
| 26 | 26 | | 21.057; |
|---|
| 27 | 27 | | (5) state curriculum and graduation requirements |
|---|
| 28 | 28 | | adopted under Chapter 28; and |
|---|
| 29 | 29 | | (6) [(4)] academic and financial accountability and |
|---|
| 30 | 30 | | sanctions under Chapters 39 and 39A. |
|---|
| 31 | 31 | | SECTION 2. Section 21.001, Education Code, is amended by |
|---|
| 32 | 32 | | adding Subdivision (3-b) to read as follows: |
|---|
| 33 | 33 | | (3-b) "Teacher of record" means a person employed by a |
|---|
| 34 | 34 | | school district who teaches the majority of the instructional day |
|---|
| 35 | 35 | | in an academic instructional setting and is responsible for |
|---|
| 36 | 36 | | evaluating student achievement and assigning grades. |
|---|
| 37 | 37 | | SECTION 3. Subchapter A, Chapter 21, Education Code, is |
|---|
| 38 | 38 | | amended by adding Section 21.0032 to read as follows: |
|---|
| 39 | 39 | | Sec. 21.0032. EMPLOYMENT OF CERTAIN UNCERTIFIED CLASSROOM |
|---|
| 40 | 40 | | TEACHERS. A school district may not employ as a classroom teacher a |
|---|
| 41 | 41 | | person who does not hold an appropriate certificate or permit |
|---|
| 42 | 42 | | issued by the State Board for Educator Certification under |
|---|
| 43 | 43 | | Subchapter B as the teacher of record for: |
|---|
| 44 | 44 | | (1) a reading language arts or mathematics course in |
|---|
| 45 | 45 | | kindergarten through grade five; |
|---|
| 46 | 46 | | (2) a mathematics course in grades six through eight; |
|---|
| 47 | 47 | | or |
|---|
| 48 | 48 | | (3) a course or combination of courses that requires |
|---|
| 49 | 49 | | at least two years of relevant coursework or experience for |
|---|
| 50 | 50 | | appropriate certification. |
|---|
| 51 | 51 | | SECTION 4. This Act applies beginning with the 2026-2027 |
|---|
| 52 | 52 | | school year. |
|---|
| 53 | 53 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 57 | 57 | | Act takes effect September 1, 2025. |
|---|
