11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 541.103, Business & Commerce Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | Sec. 541.103. SALE OF DATA TO THIRD PARTIES AND PROCESSING | |
15 | 15 | DATA FOR TARGETED ADVERTISING; DISCLOSURE; PAYMENTS TO CONSUMER. | |
16 | 16 | (a) If a controller sells personal data to third parties or | |
17 | 17 | processes personal data for targeted advertising, the controller | |
18 | 18 | shall clearly and conspicuously disclose that process and the | |
19 | 19 | manner in which a consumer may exercise the right to opt out of that | |
20 | 20 | process. | |
21 | 21 | (b) If a controller sells a consumer's personal data to a | |
22 | 22 | third party, the controller shall pay to the consumer 10 percent of | |
23 | 23 | the gross proceeds of the sale not later than the 60th day after the | |
24 | 24 | date the sale is completed. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2025. |
