46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to requirements for certain complaints made against and
79 disciplinary proceedings involving a physician.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 154.051, Occupations Code, is amended by
1012 adding Subsection (c-1) to read as follows:
1113 (c-1) The board may not consider or act on a complaint
1214 unless the complaint is sworn and notarized.
1315 SECTION 2. Section 154.0561, Occupations Code, is amended
1416 by adding Subsection (e) to read as follows:
1517 (e) The board shall notify a physician who is the subject of
1618 a complaint reviewed under this section of the identity of each
1719 expert physician participating in the review.
1820 SECTION 3. Section 164.003(f), Occupations Code, is amended
1921 to read as follows:
2022 (f) The notice required by Subsection (b)(2) must be
2123 accompanied by a written statement of the nature of the allegations
2224 and the information the board intends to use at the meeting. If the
2325 board does not provide the statement or information at that time,
2426 the license holder may use that failure as grounds for rescheduling
2527 the informal meeting. If the complaint includes an allegation that
2628 the license holder has violated the standard of care, the notice
2729 must include a copy of each report prepared by an expert physician
2830 reviewer under Section 154.0561 and the name of each reviewer who
2931 prepared a report. The license holder must provide to the board
3032 the license holder's rebuttal at least 15 business days before the
3133 date of the meeting in order for the information to be considered at
3234 the meeting.
3335 SECTION 4. Section 164.0031, Occupations Code, is amended
3436 by adding Subsection (d) to read as follows:
3537 (d) Not later than the third day before the date of an
3638 informal meeting or other informal proceeding, the board must give
3739 notice to the affected physician of the identity of each panelist
3840 conducting the meeting or proceeding.
3941 SECTION 5. Section 164.005, Occupations Code, is amended by
4042 adding Subsection (d-1) to read as follows:
4143 (d-1) The copy of the charges served on the respondent or
4244 the respondent's counsel of record under Subsection (d) must
4345 include:
4446 (1) the identity of any expert the board intends to
4547 present testimony in a formal hearing on the charges; and
4648 (2) a copy of any written report regarding the
4749 respondent prepared at the request of the board by an expert
4850 required to be identified under Subdivision (1).
4951 SECTION 6. Subchapter A, Chapter 164, Occupations Code, is
5052 amended by adding Section 164.0065 to read as follows:
5153 Sec. 164.0065. EXPERT TESTIMONY IN FORMAL HEARING.
5254 Notwithstanding any provision of Chapter 2001, Government Code,
5355 the board may not present testimony from an expert in a formal
5456 hearing before the State Office of Administrative Hearings unless
5557 the expert is identified under Section 164.005(d-1).
5658 SECTION 7. Section 164.003(f-1), Occupations Code, is
5759 repealed.
5860 SECTION 8. The changes in law made by this Act apply only to
5961 a complaint under Chapter 154, Occupations Code, or disciplinary
6062 action under Chapter 164, Occupations Code, initiated on or after
6163 the effective date of this Act.
6264 SECTION 9. This Act takes effect September 1, 2025.
