| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 2154.202(g), Occupations Code, is | |
| 13 | 13 | amended to read as follows: | |
| 14 | 14 | (g) A [Except as provided by Subsection (h), a] retail | |
| 15 | 15 | fireworks permit holder may sell fireworks only to the public | |
| 16 | 16 | during the period the permit is valid [, and only during periods: | |
| 17 | 17 | [(1) beginning June 24 and ending at midnight on July | |
| 18 | 18 | 4; | |
| 19 | 19 | [(2) beginning December 20 and ending at midnight on | |
| 20 | 20 | January 1 of the following year; and | |
| 21 | 21 | [(3) beginning May 1 and ending at midnight on May 5 if | |
| 22 | 22 | the fireworks are sold at a location that is not more than 100 miles | |
| 23 | 23 | from the Texas-Mexico border and that is in a county in which the | |
| 24 | 24 | commissioners court of the county has approved the sale of | |
| 25 | 25 | fireworks during the period]. | |
| 26 | 26 | SECTION 2. Section 2154.202(h), Occupations Code, is | |
| 27 | 27 | repealed. | |
| 28 | 28 | SECTION 3. This Act takes effect September 1, 2025. |
