77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a prohibition on marketing, advertising, or selling
1010 certain e-cigarette products; creating a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 161.0876(b), Health and Safety Code, is
1313 amended to read as follows:
1414 (b) A person commits an offense if the person markets,
1515 advertises, sells, or causes to be sold an e-cigarette product:
1616 (1) in a product [, if the product's] container that:
1717 (A) [(1)] depicts a cartoon-like fictional
1818 character that mimics a character primarily aimed at entertaining
1919 minors;
2020 (B) [(2)] imitates or mimics trademarks or trade
2121 dress of products that are or have been primarily marketed to
2222 minors;
2323 (C) [(3)] includes a symbol that is primarily
2424 used to market products to minors;
2525 (D) [(4)] includes an image of a celebrity; or
2626 (E) [(5)] includes an image that resembles a food
2727 product, including candy or juice;
2828 (2) in a product shape or design disguised to appear as
2929 an alternative product, including a product in the shape or design
3030 of:
3131 (A) a school or office supply, such as a
3232 highlighter, marker, ink pen, or pencil;
3333 (B) a smart phone, smart watch, smart phone case,
3434 or smart watch case;
3535 (C) headphones, including ear buds;
3636 (D) clothing;
3737 (E) a backpack;
3838 (F) a cosmetic, including lipstick; or
3939 (G) a toy; or
4040 (3) that was manufactured in China.
4141 SECTION 2. The change in law made by this Act applies only
4242 to an offense committed on or after the effective date of this Act.
4343 An offense committed before the effective date of this Act is
4444 governed by the law in effect on the date the offense was committed,
4545 and the former law is continued in effect for that purpose. For
4646 purposes of this section, an offense was committed before the
4747 effective date of this Act if any element of the offense occurred
4848 before that date.
4949 SECTION 3. This Act takes effect September 1, 2025.
