77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the creation of a Texas conditional driver's permit,
1010 provisional Texas conditional driver's permit, and Texas
1111 conditional learner permit; authorizing a fee.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 521, Transportation Code, is amended by
1414 adding Subchapter K-1 to read as follows:
1515 SUBCHAPTER K-1. TEXAS CONDITIONAL DRIVER'S PERMIT
1616 Sec. 521.231. ELIGIBILITY. (a) The department may issue a
1717 Texas conditional driver's permit, a provisional Texas conditional
1818 driver's permit, or a Texas conditional learner permit to a person
1919 who:
2020 (1) as of the date the permit is issued, has resided in
2121 this state for at least one year;
2222 (2) is unable to present to the department
2323 documentation issued by the United States agency responsible for
2424 citizenship and immigration authorizing the person to be in the
2525 United States;
2626 (3) is not ineligible for a driver's license under
2727 Section 521.202; and
2828 (4) regardless of the person's age, has completed a
2929 driver education course required by Section 521.1601 and an
3030 examination required by Section 521.161, except as provided by
3131 Subsection (b).
3232 (b) A person may be issued a Texas conditional learner
3333 permit without having passed the driving test under Section
3434 521.161.
3535 Sec. 521.232. PERMIT REQUIREMENTS. (a) A permit issued
3636 under this subchapter is valid as proof of the permit holder's
3737 identity for driving purposes only. The permit is not valid as
3838 proof of the permit holder's identity for any federal purpose,
3939 including voting.
4040 (b) The department shall:
4141 (1) designate and clearly mark each permit issued
4242 under this subchapter;
4343 (2) designate and clearly mark each provisional Texas
4444 conditional driver's permit or Texas conditional learner permit, as
4545 applicable, issued to a person who is younger than 18 years of age;
4646 (3) include on a permit issued under this subchapter
4747 an indication that the permit is valid proof of identity for driving
4848 purposes only and is not valid as proof of identity for any federal
4949 purpose, including voting; and
5050 (4) design the permit to appear substantially similar
5151 to the design of a driver's license.
5252 (c) Except as otherwise provided by this chapter:
5353 (1) a holder of a Texas conditional driver's permit is
5454 subject to the laws of this state applicable to the holder of an
5555 original or duplicate driver's license;
5656 (2) a holder of a provisional Texas conditional
5757 driver's permit is subject to the laws of this state applicable to
5858 the holder of a provisional driver's license; and
5959 (3) a holder of a Texas conditional learner permit is
6060 subject to the laws of this state applicable to the holder of a
6161 learner license.
6262 (d) The department shall adopt rules:
6363 (1) regarding the design and content of permits issued
6464 under this subchapter;
6565 (2) establishing criteria for proof of identification
6666 and residency of an applicant;
6767 (3) requiring a check of state and national criminal
6868 history record information to determine whether an applicant is
6969 eligible for a permit under Section 521.231(a)(3); and
7070 (4) regarding qualifications for the issuance of
7171 provisional Texas conditional driver's permits and Texas
7272 conditional learner permits.
7373 Sec. 521.233. APPLICATION. (a) An application for a permit
7474 under this subchapter must state the applicant's full name and
7575 place and date of birth. This information must be verified by
7676 presentation of one document establishing the applicant's identity
7777 and age, including:
7878 (1) a current passport or consular document issued to
7979 the applicant by the country of which the applicant is a citizen;
8080 (2) a current border crossing card;
8181 (3) a current Mexican voter registration card
8282 (Instituto Nacional Electoral credencial para votar);
8383 (4) an individual taxpayer identification number
8484 issued by the Internal Revenue Service; or
8585 (5) another identification document the department
8686 determines by rule is acceptable as proof of the information.
8787 (b) The application must include:
8888 (1) the applicant's thumbprints or, if thumbprints
8989 cannot be taken, the index fingerprints of the applicant;
9090 (2) a photograph of the applicant;
9191 (3) the signature of the applicant;
9292 (4) a brief description of the applicant;
9393 (5) any information necessary to perform a criminal
9494 history background check on the applicant; and
9595 (6) evidence that the applicant has resided in this
9696 state for at least one year.
9797 (c) The application must state:
9898 (1) the sex of the applicant;
9999 (2) the residence address of the applicant;
100100 (3) whether the applicant has been licensed to drive a
101101 motor vehicle before;
102102 (4) if previously licensed:
103103 (A) when and by what state or country;
104104 (B) whether that license has been suspended or
105105 revoked or a license application denied; and
106106 (C) if applicable, the date and reason for the
107107 suspension, revocation, or denial; and
108108 (5) the county of residence of the applicant.
109109 (d) Regardless of the applicant's age, the application must
110110 state whether the applicant has completed a driver education course
111111 required by Section 521.1601 and each applicable examination
112112 required by Section 521.161.
113113 (e) The application must be accompanied by evidence of
114114 financial responsibility that complies with the requirements of
115115 Section 521.143.
116116 (f) The application must include any other information the
117117 department requires to determine the applicant's eligibility as
118118 required by state law.
119119 (g) Information collected by the department under this
120120 section is confidential and not subject to disclosure under Chapter
121121 552, Government Code.
122122 (h) Information supplied to the department relating to an
123123 applicant's medical history is for the confidential use of the
124124 department and may not be disclosed to any person or used as
125125 evidence in a legal proceeding other than a proceeding under
126126 Subchapter N. This subsection does not apply to information
127127 provided by an applicant under Subsection (i).
128128 (i) The application must provide space for the applicant to
129129 voluntarily list any health condition that may impede communication
130130 with a peace officer as evidenced by a written statement from a
131131 licensed physician.
132132 (j) Information supplied to the department relating to the
133133 applicant's criminal history is for the confidential use of the
134134 department and may not be disclosed to any person or used as
135135 evidence in a legal proceeding, including an immigration
136136 proceeding.
137137 Sec. 521.234. FEES. The fee for the issuance or renewal of
138138 a Texas conditional driver's permit or the issuance of a
139139 provisional Texas conditional driver's permit or a Texas
140140 conditional learner permit is $100 or an amount set by the
141141 department, not to exceed $100. The department may set the fee at
142142 an amount that is less than $100 if:
143143 (1) the amount is sufficient to cover the department's
144144 costs of administering this subchapter based on the department's
145145 costs of administering this subchapter during the previous fiscal
146146 year; and
147147 (2) the department has fully recouped the cost of
148148 initially implementing this subchapter from the total amount of
149149 fees collected under this subchapter.
150150 Sec. 521.235. EXPIRATION. (a) Each Texas conditional
151151 driver's permit issued or renewed under this subchapter expires two
152152 years after the date of issuance.
153153 (b) Each provisional Texas conditional driver's permit and
154154 Texas conditional learner permit issued under this subchapter
155155 expires on the 18th birthday of the permit holder.
156156 Sec. 521.236. RENEWAL. The department shall allow an
157157 eligible applicant to renew a Texas conditional driver's permit in
158158 the same manner and locations as an applicant for the renewal of a
159159 driver's license under Subchapter M.
160160 SECTION 2. Not later than January 1, 2026, the Department of
161161 Public Safety of the State of Texas shall:
162162 (1) adopt the rules necessary to implement Subchapter
163163 K-1, Chapter 521, Transportation Code, as added by this Act; and
164164 (2) create the application form required by Section
165165 521.233, Transportation Code, as added by this Act.
166166 SECTION 3. This Act takes effect September 1, 2025.
