| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 2154.202, Occupations Code, is amended |
|---|
| 10 | 12 | | by adding Subsection (g) (4) to read as follows: |

| 11 | 13 | | (g) Except as provided by Subsection (h), a retail fireworks |
|---|
| 12 | 14 | | permit holder may sell fireworks only to the public, and only during |
|---|
| 13 | 15 | | periods: |
|---|
| 14 | 16 | | (1) beginning June 24 and ending at midnight on July 4; |
|---|
| 15 | 17 | | (2) beginning December 20 and ending at midnight on January |
|---|
| 16 | 18 | | 1 of the following year; and |
|---|
| 17 | 19 | | (3) beginning May 1 and ending at midnight on May 5 if the |
|---|
| 18 | 20 | | fireworks are sold at a location that is not more than 100 miles |
|---|
| 19 | 21 | | from the Texas-Mexico border and that is in a county in which the |
|---|
| 20 | 22 | | commissioners court of the county has approved the sale of |
|---|
| 21 | 23 | | fireworks during the period. |
|---|
| 22 | 24 | | (4) beginning five days before Lunar New Year and ending at |
|---|
| 23 | 25 | | midnight on Lunar New Year. |
|---|
| 24 | 26 | | SECTION 2. This Act takes effect September 1, 2025. |
