46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the sale of fireworks on and before the Lunar New Year
79 holiday.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 2154.202, Occupations Code, is amended
1012 by adding Subsection (g) (4) to read as follows:
1113 (g) Except as provided by Subsection (h), a retail fireworks
1214 permit holder may sell fireworks only to the public, and only during
1315 periods:
1416 (1) beginning June 24 and ending at midnight on July 4;
1517 (2) beginning December 20 and ending at midnight on January
1618 1 of the following year; and
1719 (3) beginning May 1 and ending at midnight on May 5 if the
1820 fireworks are sold at a location that is not more than 100 miles
1921 from the Texas-Mexico border and that is in a county in which the
2022 commissioners court of the county has approved the sale of
2123 fireworks during the period.
2224 (4) beginning five days before Lunar New Year and ending at
2325 midnight on Lunar New Year.
2426 SECTION 2. This Act takes effect September 1, 2025.
