88 AN ACT
99 relating to a temporary local option exemption from ad valorem
1010 taxation by a taxing unit of the total appraised value of surplus
1111 real property a person purchases from the El Paso Independent
1212 School District.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter B, Chapter 11, Tax Code, is amended by
1515 adding Section 11.39 to read as follows:
1616 Sec. 11.39. SURPLUS REAL PROPERTY PURCHASED FROM EL PASO
1717 INDEPENDENT SCHOOL DISTRICT. The governing body of a taxing unit by
1818 official action of the governing body adopted in the manner
1919 required by law for official actions may exempt from taxation for a
2020 period of 10 years the total appraised value of surplus real
2121 property a person purchases from the El Paso Independent School
2222 District.
2323 SECTION 2. This Act applies only to ad valorem taxes imposed
2424 for a tax year beginning on or after the effective date of this Act.
2525 SECTION 3. This Act takes effect January 1, 2026, but only
2626 if the constitutional amendment proposed by the 89th Legislature,
2727 Regular Session, 2025, to authorize the legislature to provide for
2828 a temporary local option exemption from ad valorem taxation by a
2929 political subdivision of the total market value of surplus real
3030 property a person purchases from a school district is approved by
3131 the voters. If that amendment is not approved by the voters, this
3232 Act has no effect.
