77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a policy prohibiting antisemitism at public
1010 institutions of higher education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1313 amended by adding Section 51.9317 to read as follows:
1414 Sec. 51.9317. ANTISEMITISM PROHIBITED. (a) In this
1515 section:
1616 (1) "Antisemitism" has the meaning assigned by Section
1717 448.001, Government Code, including the examples referenced in that
1818 term.
1919 (2) "Institution of higher education" has the meaning
2020 assigned by Section 61.003.
2121 (b) Each institution of higher education shall adopt a
2222 policy that:
2323 (1) prohibits students and student organizations from
2424 engaging in antisemitism-motivated violence or speech intended to
2525 imminently incite violence or other unlawful action against or
2626 toward a Jewish person or the Jewish community; and
2727 (2) establishes disciplinary sanctions for students
2828 and student organizations, including expulsion from the
2929 institution or disbanding of the student organization, that engage
3030 in conduct prohibited by Subdivision (1).
3131 (c) An institution of higher education may not spend money
3232 appropriated to the institution for a state fiscal year until the
3333 governing board of the institution submits to the legislature and
3434 the Texas Higher Education Coordinating Board a report certifying
3535 the institution's compliance with this section during the preceding
3636 state fiscal year.
3737 SECTION 2. (a) Except as provided by Subsection (b) of this
3838 section, this Act applies beginning with the 2025-2026 academic
3939 year.
4040 (b) Section 51.9317(c), Education Code, as added by this
4141 Act, applies beginning with money appropriated to a public
4242 institution of higher education for a state fiscal year beginning
4343 September 1, 2026.
4444 SECTION 3. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2025.
