88 AN ACT
99 relating to continuing medical education requirements for certain
1010 physicians regarding adoption.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 156, Occupations Code, is
1313 amended by adding Section 156.061 to read as follows:
1414 Sec. 156.061. CONTINUING MEDICAL EDUCATION REGARDING TEXAS
1515 ADOPTION LAW. (a) A physician licensed under this subtitle who
1616 submits an application for renewal of a registration permit and
1717 whose practice includes treating pregnant women must complete not
1818 less than two hours of continuing medical education related to
1919 Texas adoption law.
2020 (b) Continuing medical education under this section must
2121 include education regarding:
2222 (1) procedures for the termination of the parental
2323 rights of an alleged biological father for the purpose of adoption
2424 under Section 161.002, Family Code;
2525 (2) procedures for the voluntary termination of
2626 parental rights before and after birth under Sections 161.102 and
2727 161.103, Family Code;
2828 (3) procedures for a mother to authorize the release
2929 of her newborn child from a hospital or birthing center to a
3030 licensed child placing agency, the Department of Family and
3131 Protective Services, or another designated person under Section
3232 161.108, Family Code;
3333 (4) terms regarding limited post-termination contact
3434 that may be included in an order terminating the parent-child
3535 relationship under Section 161.2061, Family Code;
3636 (5) provisions for a designated emergency infant care
3737 provider to take possession of an abandoned child under Section
3838 262.302, Family Code;
3939 (6) financial assistance that a child-placing agency
4040 may pay to an expectant mother as described by Section 25.08(b)(4),
4141 Penal Code; and
4242 (7) differences between private adoption and foster
4343 care adoption, including:
4444 (A) the processes and legal requirements for
4545 private adoption and foster care adoption;
4646 (B) the role of private adoption agencies and the
4747 Department of Family and Protective Services with respect to
4848 facilitating adoption;
4949 (C) support services available to expectant
5050 mothers and adoptive families through private adoption and foster
5151 care adoption; and
5252 (D) the rights and responsibilities of birth
5353 parents, adoptive parents, and this state in private adoption and
5454 foster care adoption.
5555 (c) A physician must complete the hours required by
5656 Subsection (a) in each of the first two renewal periods following
5757 the issuance of the physician's initial registration permit under
5858 this chapter, with at least one hour to be completed not later than
5959 the first anniversary of the date of issuance.
6060 (d) After the period described by Subsection (c), a
6161 physician must complete not less than two hours of continuing
6262 medical education described by Subsection (b) every eight years.
6363 (e) The hours required by this section may be counted toward
6464 the hours of continuing medical education completed to comply with
6565 Section 156.051(a)(2).
6666 (f) The board shall adopt rules to implement this section,
6767 including rules establishing content and approval requirements to
6868 ensure the continuing medical education described by this section
6969 aligns with current medical standards and guidelines.
7070 SECTION 2. Not later than December 1, 2025, the Texas
7171 Medical Board shall adopt the rules necessary to implement the
7272 changes in law made by this Act.
7373 SECTION 3. This Act takes effect September 1, 2025.
