77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an exemption from sales and use taxes for items used to
1010 construct a nuclear project.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter H, Chapter 151, Tax Code, is amended
1313 by adding Section 151.3183 to read as follows:
1414 Sec. 151.3183. NUCLEAR PROJECTS. (a) In this section,
1515 "nuclear project" includes a:
1616 (1) nuclear power generation site or facility;
1717 (2) nuclear reactor;
1818 (3) nuclear reactor manufacturing facility;
1919 (4) facility for reprocessing or recycling nuclear
2020 fuel; and
2121 (5) facility for enriching uranium.
2222 (b) A taxable item is exempted from the taxes imposed by
2323 this chapter if the item is incorporated into a nuclear project or
2424 consumed in the construction of a nuclear project.
2525 SECTION 2. The change in law made by this Act does not
2626 affect tax liability accruing before the effective date of this
2727 Act. That liability continues in effect as if this Act had not been
2828 enacted, and the former law is continued in effect for the
2929 collection of taxes due and for civil and criminal enforcement of
3030 the liability for those taxes.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2025.
