77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to measures to ensure public school transparency and
1010 accountability, including school district board of trustees
1111 meeting requirements, posting of certain information on a public
1212 school's Internet website, the creation of a grievance portal, and
1313 the inclusion of a transparency and accountability domain in the
1414 public school accountability system.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 11.0621, Education Code, is amended to
1717 read as follows:
1818 Sec. 11.0621. MEETINGS. (a) The minutes, certified
1919 agenda, or recording, as applicable, of a regular or special
2020 meeting of the board of trustees must reflect each member's
2121 attendance at or absence from the meeting. The minutes or tape
2222 recording of an open meeting must be accessible to the public in
2323 accordance with Section 551.022, Government Code.
2424 (b) The board of trustees of a school district shall:
2525 (1) conduct all business of the board in a public and
2626 open manner unless the board is addressing sensitive personnel
2727 issues or a matter required to be kept confidential by law;
2828 (2) allow public comment at the beginning of each
2929 regular board meeting; and
3030 (3) address any issue raised during the public comment
3131 period under Subdivision (2) during the same board meeting in which
3232 the issue was raised.
3333 SECTION 2. Subchapter D, Chapter 11, Education Code, is
3434 amended by adding Section 11.1519 to read as follows:
3535 Sec. 11.1519. POSTING OF DISTRICT RULES, POLICIES, AND
3636 PROCEDURES. (a) A school district shall post on the district's
3737 Internet website in a manner easily accessible to the public each
3838 rule, policy, and procedure applicable to students or staff adopted
3939 by the district.
4040 (b) A school district must update the district's Internet
4141 website not later than the 30th day after the date on which the
4242 district adopts or modifies a rule, policy, or procedure applicable
4343 to students or staff.
4444 SECTION 3. Subchapter D, Chapter 12, Education Code, is
4545 amended by adding Section 12.142 to read as follows:
4646 Sec. 12.142. POSTING OF SCHOOL RULES, POLICIES, AND
4747 PROCEDURES. (a) An open-enrollment charter school shall post on
4848 the school's Internet website in a manner easily accessible to the
4949 public each rule, policy, and procedure applicable to students or
5050 staff adopted by the school.
5151 (b) An open-enrollment charter school must update the
5252 school's Internet website not later than the 30th day after the date
5353 on which the school adopts or modifies a rule, policy, or procedure
5454 applicable to students or staff.
5555 SECTION 4. Chapter 26, Education Code, is amended by adding
5656 Section 26.0115 to read as follows:
5757 Sec. 26.0115. GRIEVANCE PORTAL. The agency shall develop
5858 an Internet portal through which a person may file a grievance
5959 concerning a school district or open-enrollment charter school.
6060 The portal must allow for a person to easily:
6161 (1) file a grievance and forward the grievance to the
6262 appropriate district or school;
6363 (2) track a grievance that has been filed through the
6464 portal;
6565 (3) access a copy of the resolution of the grievance;
6666 and
6767 (4) if the grievance is not resolved to the person's
6868 satisfaction by the district or school, file an appeal with the
6969 commissioner in accordance with Section 7.057.
7070 SECTION 5. Subchapter C, Chapter 31, Education Code, is
7171 amended by adding Section 31.107 to read as follows:
7272 Sec. 31.107. POSTING OF INSTRUCTIONAL MATERIALS. A school
7373 district or open-enrollment charter school shall post on the
7474 district's or school's Internet website in an easily accessible
7575 manner the list of instructional materials used by the district or
7676 school for each grade level.
7777 SECTION 6. Subchapter B, Chapter 33, Education Code, is
7878 amended by adding Section 33.028 to read as follows:
7979 Sec. 33.028. POSTING OF LIBRARY CATALOG. A school district
8080 or open-enrollment charter school shall post on the district's or
8181 school's Internet website in an easily accessible manner the
8282 catalog of available library materials at each school library in
8383 the district or school.
8484 SECTION 7. Section 39.053(c), Education Code, is amended to
8585 read as follows:
8686 (c) School districts and campuses must be evaluated based on
8787 four [three] domains of indicators of achievement adopted under
8888 this section that include:
8989 (1) in the student achievement domain, indicators of
9090 student achievement that must include:
9191 (A) for evaluating the performance of districts
9292 and campuses generally:
9393 (i) an indicator that accounts for the
9494 results of assessment instruments required under Sections
9595 39.023(a), (c), and (l), as applicable for the district and campus,
9696 including the results of assessment instruments required for
9797 graduation retaken by a student, aggregated across grade levels by
9898 subject area, including:
9999 (a) for the performance standard
100100 determined by the commissioner under Section 39.0241(a), the
101101 percentage of students who performed satisfactorily on the
102102 assessment instruments, aggregated across grade levels by subject
103103 area; and
104104 (b) for the college readiness
105105 performance standard as determined under Section 39.0241, the
106106 percentage of students who performed satisfactorily on the
107107 assessment instruments, aggregated across grade levels by subject
108108 area; and
109109 (ii) an indicator that accounts for the
110110 results of assessment instruments required under Section
111111 39.023(b), as applicable for the district and campus, including the
112112 percentage of students who performed satisfactorily on the
113113 assessment instruments, as determined by the performance standard
114114 adopted by the agency, aggregated across grade levels by subject
115115 area; and
116116 (B) for evaluating the performance of high school
117117 campuses and districts that include high school campuses,
118118 indicators that account for:
119119 (i) students who satisfy the Texas Success
120120 Initiative (TSI) college readiness benchmarks prescribed by the
121121 Texas Higher Education Coordinating Board under Section 51.334 on
122122 an assessment instrument in reading or mathematics designated by
123123 the coordinating board under that section;
124124 (ii) students who satisfy relevant
125125 performance standards on advanced placement tests or similar
126126 assessments;
127127 (iii) students who earn dual course credits
128128 in the dual credit courses;
129129 (iv) students who enlist in the armed
130130 forces of the United States or the Texas National Guard;
131131 (v) students who earn industry
132132 certifications;
133133 (vi) students admitted into postsecondary
134134 industry certification programs that require as a prerequisite for
135135 entrance successful performance at the secondary level;
136136 (vii) students whose successful completion
137137 of a course or courses under Section 28.014 indicates the student's
138138 preparation to enroll and succeed, without remediation, in an
139139 entry-level general education course for a baccalaureate degree or
140140 associate degree;
141141 (viii) students who successfully met
142142 standards on a composite of indicators that through research
143143 indicates the student's preparation to enroll and succeed, without
144144 remediation, in an entry-level general education course for a
145145 baccalaureate degree or associate degree;
146146 (ix) high school graduation rates, computed
147147 in accordance with standards and definitions adopted in compliance
148148 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
149149 subject to the exclusions provided by Subsections (g), (g-1),
150150 (g-2), (g-3), and (g-4);
151151 (x) students who successfully completed an
152152 OnRamps dual enrollment course;
153153 (xi) students who successfully completed a
154154 practicum or internship approved by the State Board of Education;
155155 (xii) students who are awarded an associate
156156 degree; and
157157 (xiii) students who successfully completed
158158 a program of study in career and technical education;
159159 (2) in the school progress domain, indicators for
160160 effectiveness in promoting student learning, which must include:
161161 (A) for assessment instruments, including
162162 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
163163 percentage of students who met the standard for improvement, as
164164 determined by the commissioner; and
165165 (B) for evaluating relative performance, the
166166 performance of districts and campuses compared to similar districts
167167 or campuses; [and]
168168 (3) in the closing the gaps domain, the use of
169169 disaggregated data to demonstrate the differentials among students
170170 from different racial and ethnic groups, socioeconomic
171171 backgrounds, and other factors, including:
172172 (A) students formerly receiving special
173173 education services;
174174 (B) students continuously enrolled; and
175175 (C) students who are mobile; and
176176 (4) in the transparency and accountability domain,
177177 indicators for effectiveness in promoting transparency and
178178 accountability with respect to district or campus operations.
179179 SECTION 8. Section 39.301(d), Education Code, is amended to
180180 read as follows:
181181 (d) Performance on the indicators described by Sections
182182 39.053(c)(1), (2), and (3) [Section 39.053(c)] and Subsections
183183 (c)(3), (4), and (9) of this section must be based on longitudinal
184184 student data that is disaggregated by the bilingual education or
185185 special language program, if any, in which emergent bilingual
186186 students, as defined by Section 29.052, are or former emergent
187187 bilingual students were enrolled. If a student described by this
188188 subsection is not or was not enrolled in specialized language
189189 instruction, the number and percentage of those students shall be
190190 provided.
191191 SECTION 9. This Act applies beginning with the 2025-2026
192192 school year.
193193 SECTION 10. This Act takes effect immediately if it
194194 receives a vote of two-thirds of all the members elected to each
195195 house, as provided by Section 39, Article III, Texas Constitution.
196196 If this Act does not receive the vote necessary for immediate
197197 effect, this Act takes effect September 1, 2025.
