77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a prohibition on the referral of a suit affecting the
1010 parent-child relationship filed by a governmental entity to a court
1111 designated as a juvenile court in certain counties.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 103, Family Code, is amended by adding
1414 Section 103.004 to read as follows:
1515 Sec. 103.004. PROHIBITION ON CERTAIN TRANSFERS. (a) In
1616 this section, "dual status child" has the meaning assigned by
1717 Section 51.02.
1818 (b) A court in a county that has a population of 3.3 million
1919 or more may not transfer any aspect of a suit filed by a
2020 governmental entity under Subtitle E to a court designated as a
2121 juvenile court in the county, regardless of whether a dual status
2222 child is a subject of the suit.
2323 SECTION 2. The change in law made by this Act applies to a
2424 suit affecting the parent-child relationship that is pending in a
2525 trial court on the effective date of this Act or that is filed on or
2626 after the effective date of this Act.
2727 SECTION 3. This Act takes effect September 1, 2025.
