                    BILL ANALYSIS             C.S.H.B. 5153     By: Rose     Human Services     Committee Report (Substituted)             BACKGROUND AND PURPOSE    In 2021, the 87th Legislature enacted legislation requiring the Texas Health and Human Services Commission (HHSC) to enroll local health departments (LHD) as a provider type for reimbursement under Texas Medicaid. The bill author has informed the committee that LHDs play a key role in increasing access to healthcare, preventing and controlling diseases, and ensuring community health and safety and that in 2023, the Department of State Health Services Infectious Disease Prevention Section and HHSC Medicaid and CHIP Services leadership initiated conversations regarding how CHIP members receive immunizations, specifically at LHDs. The bill author has further informed the committee that the frequent occurrence of households with children enrolled in both Medicaid and CHIP warrants continued service delivery innovation to ensure children in those programs can access preventative health screenings, immunizations, dental check ups, and other services at local health entities. C.S.H.B. 5153 seeks to address this issue and improve child preventative service delivery by requiring the executive commissioner of HHSC to establish a separate provider type for a local public health entity for purposes of enrollment and reimbursement as a provider under CHIP.       CRIMINAL JUSTICE IMPACT   It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.       RULEMAKING AUTHORITY    It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.       ANALYSIS    C.S.H.B. 5153 amends the Health and Safety Code to require the executive commissioner of the Health and Human Services Commission (HHSC) to establish a separate provider type for a local public health entity for purposes of enrollment and reimbursement as a provider under CHIP. The bill defines "local public health entity" as a local health unit described by the Local Public Health Reorganization Act and a local health department and a public health district established under that act.   If before implementing any provision of the bill a state agency determines that a waiver or authorization from a federal agency is necessary for implementation of that provision, the agency affected by the provision must request the waiver or authorization and may delay implementing that provision until the waiver or authorization is granted. Implementation of a provision of this bill by HHSC is mandatory only if a specific appropriation is made for that purpose.        EFFECTIVE DATE    On passage, or, if the bill does not receive the necessary vote, September 1, 2025.       COMPARISON OF INTRODUCED AND SUBSTITUTE   C.S.H.B. 5153 differs from the introduced in minor or nonsubstantive ways by conforming to certain bill drafting conventions and by amending the caption.
