46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to amending Chapter 62, Health and Safety Code, by adding
79 certain local health entities as provider types for reimbursement
810 under the Children's Health Insurance Program.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 62.002, Health and Safety Code, is
1113 amended by adding Subdivision (5) to read as follows:
1214 (5) "Local public health entity" means an entity
1315 established by Chapter 121 (Local Public Health Reorganization
1416 Act), including health authorities established under Section
1517 121.021, local health departments established under Section
1618 121.031, and public health districts established under Section
1719 121.041.
1820 SECTION 2. Section 62.156, Health and Safety Code, is
1921 amended to read as follows:
2022 (a) Health care providers who provide health care services
2123 under the child health plan must satisfy certification and
2224 licensure requirements, as required by commission rules and
2325 consistent with other law.
2426 (b) The executive commissioner shall establish a separate
2527 provider type for a local public health entity for purposes of
2628 enrollment as a provider for and reimbursement under the child
2729 health plan program.
2830 SECTION 3. If before implementing any provision of this Act
2931 a state agency determines that a waiver or authorization from a
3032 federal agency is necessary for implementation of that provision,
3133 the agency affected by the provision shall request the waiver or
3234 authorization and may delay implementing that provision until the
3335 waiver or authorization is granted.
3436 SECTION 4. The Health and Human Services Commission is
3537 required to implement a provision of this Act only if the
3638 legislature appropriates money specifically for that purpose. If
3739 the legislature does not appropriate money specifically for that
3840 purpose, the commission may, but is not required to, implement a
3941 provision of this Act using other appropriations available for that
4042 purpose.
4143 SECTION 5. This act takes effect immediately if it receives
4244 a vote of two-thirds of all the members elected to each house, as
4345 provided by Section 39, Article III, Texas Constitution. If this
4446 Act does not receive the vote necessary for immediate effect, this
4547 Act takes effect September 1, 2025.
