5	7		AN ACT
6	8		relating to amending Chapter 62, Health and Safety Code, by adding
7	9		certain local health entities as provider types for reimbursement
8	10		under the Children's Health Insurance Program.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Section 62.002, Health and Safety Code, is
11	13		amended by adding Subdivision (5) to read as follows:
12	14		(5) "Local public health entity" means an entity
13	15		established by Chapter 121 (Local Public Health Reorganization
14	16		Act), including health authorities established under Section
15	17		121.021, local health departments established under Section
16	18		121.031, and public health districts established under Section
17	19		121.041.
18	20		SECTION 2. Section 62.156, Health and Safety Code, is
19	21		amended to read as follows:
20	22		(a) Health care providers who provide health care services
21	23		under the child health plan must satisfy certification and
22	24		licensure requirements, as required by commission rules and
23	25		consistent with other law.
24	26		(b) The executive commissioner shall establish a separate
25	27		provider type for a local public health entity for purposes of
26	28		enrollment as a provider for and reimbursement under the child
27	29		health plan program.
28	30		SECTION 3. If before implementing any provision of this Act
29	31		a state agency determines that a waiver or authorization from a
30	32		federal agency is necessary for implementation of that provision,
31	33		the agency affected by the provision shall request the waiver or
32	34		authorization and may delay implementing that provision until the
33	35		waiver or authorization is granted.
34	36		SECTION 4. The Health and Human Services Commission is
35	37		required to implement a provision of this Act only if the
36	38		legislature appropriates money specifically for that purpose. If
37	39		the legislature does not appropriate money specifically for that
38	40		purpose, the commission may, but is not required to, implement a
39	41		provision of this Act using other appropriations available for that
40	42		purpose.
41	43		SECTION 5. This act takes effect immediately if it receives
42	44		a vote of two-thirds of all the members elected to each house, as
43	45		provided by Section 39, Article III, Texas Constitution. If this
44	46		Act does not receive the vote necessary for immediate effect, this
45	47		Act takes effect September 1, 2025.
