7 | 9 | | the quality and accessibility of care for certain Medicaid |

9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 12 | | SECTION 1. Subchapter B, Chapter 526, Government Code, is |
---|
11 | 13 | | amended by adding Section 526.0060 to read as follows: |
---|
12 | 14 | | Sec. 531.0738. CONTINUATION OF THE PILOT MODEL OF CARE FOR |
---|
13 | 15 | | CERTAIN MEDICAID RECIPIENTS. (a) To the extent funds are available |
---|
14 | 16 | | for this purpose, the commission shall continue the Maternal Opioid |
---|
15 | 17 | | Misuse Model pilot program, a model of care designed to improve the |
---|
16 | 18 | | quality and accessibility of care for: |
---|
17 | 19 | | (1) pregnant women with opioid use disorder enrolled |
---|
18 | 20 | | in Medicaid during the prenatal and postpartum periods; and |
---|
19 | 21 | | (2) their children after birth.(b) This section |
---|
20 | 22 | | expires December 1, 2028. |
---|
21 | 23 | | SECTION 2. Not later than December 31, 2028, the commission |
---|
22 | 24 | | shall prepare and submit to the legislature a report on the benefits |
---|
23 | 25 | | of the program, including measures of birth outcomes. |
---|
24 | 26 | | SECTION 3. To the extent available for use, the Texas opioid |
---|
25 | 27 | | abatement fund council shall prioritize funding to the Maternal |
---|
26 | 28 | | Opioid Misuse Model as a grant recipient of money allocated to the |
---|
27 | 29 | | council from the Opioid Abatement Trust Fund, established by |
---|
28 | 30 | | Section 403.506. |
---|
29 | 31 | | SECTION 4. If before implementing any provision of this Act |
---|
30 | 32 | | a state agency determines that a waiver or authorization from a |
---|
31 | 33 | | federal agency is necessary for implementation of that provision, |
---|
32 | 34 | | the agency affected by the provision shall request the waiver or |
---|
33 | 35 | | authorization and may delay implementing that provision until the |
---|
34 | 36 | | waiver or authorization is granted. |
---|
35 | 37 | | SECTION 5. The Health and Human Services Commission is |
---|
36 | 38 | | required to implement a provision of this Act only if the |
---|
37 | 39 | | legislature appropriates money specifically for that purpose. If |
---|
38 | 40 | | the legislature does not appropriate money specifically for that |
---|
39 | 41 | | purpose, the commission may, but is not required to, implement a |
---|
40 | 42 | | provision of this Act using other appropriations available for that |
---|
41 | 43 | | purpose. |
---|
42 | 44 | | SECTION 6. This Act takes effect immediately if it receives |
---|
43 | 45 | | a vote of two-thirds of all the members elected to each house, as |
---|
44 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
45 | 47 | | Act does not receive the vote necessary for immediate effect, this |
---|
46 | 48 | | Act takes effect September 1, 2025. |
---|
