46 A BILL TO BE ENTITLED
57 AN ACT
68 relating to the continuation of a pilot program designed to improve
79 the quality and accessibility of care for certain Medicaid
810 recipients.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter B, Chapter 526, Government Code, is
1113 amended by adding Section 526.0060 to read as follows:
1214 Sec. 531.0738. CONTINUATION OF THE PILOT MODEL OF CARE FOR
1315 CERTAIN MEDICAID RECIPIENTS. (a) To the extent funds are available
1416 for this purpose, the commission shall continue the Maternal Opioid
1517 Misuse Model pilot program, a model of care designed to improve the
1618 quality and accessibility of care for:
1719 (1) pregnant women with opioid use disorder enrolled
1820 in Medicaid during the prenatal and postpartum periods; and
1921 (2) their children after birth.(b) This section
2022 expires December 1, 2028.
2123 SECTION 2. Not later than December 31, 2028, the commission
2224 shall prepare and submit to the legislature a report on the benefits
2325 of the program, including measures of birth outcomes.
2426 SECTION 3. To the extent available for use, the Texas opioid
2527 abatement fund council shall prioritize funding to the Maternal
2628 Opioid Misuse Model as a grant recipient of money allocated to the
2729 council from the Opioid Abatement Trust Fund, established by
2830 Section 403.506.
2931 SECTION 4. If before implementing any provision of this Act
3032 a state agency determines that a waiver or authorization from a
3133 federal agency is necessary for implementation of that provision,
3234 the agency affected by the provision shall request the waiver or
3335 authorization and may delay implementing that provision until the
3436 waiver or authorization is granted.
3537 SECTION 5. The Health and Human Services Commission is
3638 required to implement a provision of this Act only if the
3739 legislature appropriates money specifically for that purpose. If
3840 the legislature does not appropriate money specifically for that
3941 purpose, the commission may, but is not required to, implement a
4042 provision of this Act using other appropriations available for that
4143 purpose.
4244 SECTION 6. This Act takes effect immediately if it receives
4345 a vote of two-thirds of all the members elected to each house, as
4446 provided by Section 39, Article III, Texas Constitution. If this
4547 Act does not receive the vote necessary for immediate effect, this
4648 Act takes effect September 1, 2025.
