77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a political subdivision to spend
1010 public money in support of certain professional associations that
1111 promote or implement diversity, equity, and inclusion initiatives.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 140, Local Government Code, is amended
1414 by adding Section 140.014 to read as follows:
1515 Sec. 140.014. PROHIBITION ON EXPENDITURE OF PUBLIC MONEY IN
1616 SUPPORT OF CERTAIN ASSOCIATIONS. (a) In this section:
1717 (1) "Diversity, equity, and inclusion initiative"
1818 means an initiative that:
1919 (A) is based on the belief that identity
2020 classifications are central to understanding social, professional,
2121 and political disparities;
2222 (B) requires, encourages, or otherwise promotes
2323 organizational practices such as employee hiring and promotion,
2424 resource allocation, or policy formulation to achieve proportional
2525 representation of identity classification groups or to eliminate
2626 perceived systemic differences between them; or
2727 (C) otherwise promotes discriminatory treatment
2828 of a person on the basis of the person's identity classification.
2929 (2) "Identity classification" means a classification
3030 of a person based on the race, color, religion, national origin, or
3131 ethnicity of the person.
3232 (3) "Professional association" means a nonprofit
3333 association or organization that engages in activities in support
3434 of:
3535 (A) similarly situated political subdivisions;
3636 or
3737 (B) a class of professionals.
3838 (b) A political subdivision may not spend public money in
3939 support of a professional association that promotes or implements a
4040 diversity, equity, and inclusion initiative, including by:
4141 (1) paying a membership fee or due to the association;
4242 or
4343 (2) paying for an officer or employee of the political
4444 subdivision to attend or participate in a conference or similar
4545 event hosted by the association.
4646 SECTION 2. The change in law made by this Act applies to an
4747 expenditure made by a political subdivision on or after the
4848 effective date of this Act.
4949 SECTION 3. This Act takes effect September 1, 2025.
