10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter G, Chapter 437, Government Code, is |
---|
12 | 12 | | amended by adding Section 437.3095 to read as follows: |
---|
13 | 13 | | Sec. 437.3095. TEXAS STATE GUARD RETIRED STATUS. (a) The |
---|
14 | 14 | | governor, or adjutant general under the governor's authority and |
---|
15 | 15 | | direction, shall place on retired status an officer or enlisted |
---|
16 | 16 | | service member of the Texas State Guard who: |
---|
17 | 17 | | (1) is physically disabled as a result of service; or |
---|
18 | 18 | | (2) has served the federal or state military |
---|
19 | 19 | | satisfactorily for at least 20 years. |
---|
20 | 20 | | (b) The governor, or adjutant general under the governor's |
---|
21 | 21 | | authority and direction, may advance the service member one grade |
---|
22 | 22 | | or rank at the time of the transfer into retired status. |
---|
23 | 23 | | SECTION 2. Section 437.308(a), Government Code, is amended |
---|
24 | 24 | | to read as follows: |
---|
25 | 25 | | (a) The commander of the Texas State Guard shall maintain |
---|
26 | 26 | | and preserve the individual and unit records of the Texas State |
---|
27 | 27 | | Guard and the officers and service members placed on retired status |
---|
28 | 28 | | [the Texas State Guard Honorary Reserve]. |
---|
29 | 29 | | SECTION 3. Section 437.309, Government Code, is repealed. |
---|
30 | 30 | | SECTION 4. This Act takes effect September 1, 2025. |
