77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the retired members of the Texas State Guard.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter G, Chapter 437, Government Code, is
1212 amended by adding Section 437.3095 to read as follows:
1313 Sec. 437.3095. TEXAS STATE GUARD RETIRED STATUS. (a) The
1414 governor, or adjutant general under the governor's authority and
1515 direction, shall place on retired status an officer or enlisted
1616 service member of the Texas State Guard who:
1717 (1) is physically disabled as a result of service; or
1818 (2) has served the federal or state military
1919 satisfactorily for at least 20 years.
2020 (b) The governor, or adjutant general under the governor's
2121 authority and direction, may advance the service member one grade
2222 or rank at the time of the transfer into retired status.
2323 SECTION 2. Section 437.308(a), Government Code, is amended
2424 to read as follows:
2525 (a) The commander of the Texas State Guard shall maintain
2626 and preserve the individual and unit records of the Texas State
2727 Guard and the officers and service members placed on retired status
2828 [the Texas State Guard Honorary Reserve].
2929 SECTION 3. Section 437.309, Government Code, is repealed.
3030 SECTION 4. This Act takes effect September 1, 2025.
