11- relating to the issuance of a diploma to a student graduating from a
12- public institution of higher education that has undergone a merger,
13- acquisition, or name change.
8+ relating to the diploma designation of an institution of higher
9+ education.
1410 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1511 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
16- amended by adding Section 51.995 to read as follows:
17- Sec. 51.995. DIPLOMA DESIGNATION IN EVENT OF MERGER,
18- ACQUISITION, OR NAME CHANGE. (a) In this section, "institution of
19- higher education" has the meaning assigned by Section 61.003.
20- (b) Subject to Subsection (c), if, during the period of a
21- student's enrollment at an institution of higher education, the
22- institution merges with or is acquired by another postsecondary
23- educational institution or changes the institution's name, the
24- institution shall provide to the student on the student's
25- graduation from the institution two diplomas as follows:
26- (1) one diploma in the same style, design, or format,
27- including symbols or other insignia, designating the original name
28- of the institution on the date the student initially enrolled; and
29- (2) one diploma designating the name of the
30- institution after the merger, acquisition, or name change.
31- (c) A student is eligible to receive two diplomas under this
32- section only if the student graduates from the institution of
33- higher education within six years of the merger, acquisition, or
34- name change.
35- (d) An institution of higher education may not charge a
36- student an additional fee to receive a diploma under this section.
37- SECTION 2. Section 51.995, Education Code, as added by this
38- Act, applies beginning with a diploma provided by a public
39- institution of higher education to a student for the 2025-2026
40- academic year.
41- SECTION 3. This Act takes effect immediately if it receives
42- a vote of two-thirds of all the members elected to each house, as
43- provided by Section 39, Article III, Texas Constitution. If this
44- Act does not receive the vote necessary for immediate effect, this
45- Act takes effect September 1, 2025.
12+ amended by adding Section 51.997 to read as follows:
13+ Sec. 51.997. DIPLOMA DESIGNATION IN THE CASE OF A MERGER.
14+ If an institution of higher education, as defined by Section
15+ 61.003, Education Code, merges or changes names, the institution
16+ shall offer each student enrolled at the time of the name change the
17+ option to receive a diploma with the new institution name or the
18+ former institution name.
19+ SECTION 2. The changes in law made by this act apply
20+ beginning with the 2025-2026 academic year.
21+ SECTION 3. This Act takes effect September 1, 2025.
