77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an exemption from the requirement to obtain a permit
1010 from a groundwater conservation district for certain brackish
1111 groundwater wells.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 36.117(b) and (d), Water Code, are
1414 amended to read as follows:
1515 (b) Except as provided by this section, a district shall
1616 provide an exemption from the district requirement to obtain a
1717 permit for:
1818 (1) drilling or operating a well used solely for
1919 domestic use or for providing water for livestock or poultry if the
2020 well is:
2121 (A) located or to be located on a tract of land
2222 larger than 10 acres; and
2323 (B) drilled, completed, or equipped so that it is
2424 incapable of producing more than 25,000 gallons of groundwater a
2525 day;
2626 (2) drilling a water well used solely to supply water
2727 for a rig that is actively engaged in drilling or exploration
2828 operations for an oil or gas well permitted by the Railroad
2929 Commission of Texas provided that the person holding the permit is
3030 responsible for drilling and operating the water well and the water
3131 well is located on the same lease or field associated with the
3232 drilling rig;
3333 (3) drilling a water well authorized under a permit
3434 issued by the Railroad Commission of Texas under Chapter 134,
3535 Natural Resources Code, or for production from the well to the
3636 extent the withdrawals are required for mining activities
3737 regardless of any subsequent use of the water; [or]
3838 (4) drilling a water well for temporary use to supply
3939 water for a rig that is actively engaged in drilling a groundwater
4040 production well permitted by the district; or
4141 (5) drilling or operating a well for the withdrawal of
4242 groundwater from a designated brackish groundwater production
4343 zone, as defined by Section 36.1015, if the operator of the well
4444 provides the district with documentation from a licensed water well
4545 driller or another similarly qualified third party showing that the
4646 well produces water with an average total dissolved solids
4747 concentration of at least 3,000 milligrams per liter.
4848 (d) A district may cancel a previously granted exemption and
4949 may require an operating permit for or restrict production from a
5050 well and assess any appropriate fees if:
5151 (1) the groundwater withdrawals that were exempted
5252 under Subsection (b)(1) are no longer used solely for domestic use
5353 or to provide water for livestock or poultry;
5454 (2) the groundwater withdrawals that were exempted
5555 under Subsection (b)(2) are no longer used solely to supply water
5656 for a rig that is actively engaged in drilling or exploration
5757 operations for an oil or gas well permitted by the Railroad
5858 Commission of Texas;
5959 (3) the groundwater withdrawals that were exempted
6060 under Subsection (b)(3) are no longer necessary for mining
6161 activities or are greater than the amount necessary for mining
6262 activities specified in the permit issued by the Railroad
6363 Commission of Texas under Chapter 134, Natural Resources Code; [or]
6464 (4) the groundwater withdrawals that were exempted
6565 under Subsection (b)(4) are no longer used solely to supply water
6666 for a rig that is actively engaged in drilling a groundwater
6767 production well permitted by the district; or
6868 (5) for groundwater withdrawals that were exempted
6969 under Subsection (b)(5):
7070 (A) the withdrawals are no longer from a
7171 designated brackish groundwater production zone, as defined by
7272 Section 36.1015; or
7373 (B) the groundwater produced has an average total
7474 dissolved solids concentration of less than 3,000 milligrams per
7575 liter.
7676 SECTION 2. This Act takes effect September 1, 2025.
