77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to requiring parental consent before interviewing a
1010 student regarding certain alleged incidents of misconduct in public
1111 schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C-1, Chapter 22, Education Code, is
1414 amended by adding Section 22.0933 to read as follows:
1515 Sec. 22.0933. PARENTAL CONSENT FOR STUDENT INTERVIEW
1616 REGARDING EMPLOYEE MISCONDUCT. A school district, district of
1717 innovation, open-enrollment charter school, other charter entity,
1818 regional education service center, or shared services arrangement
1919 must obtain consent from the parent of or person standing in
2020 parental relation to a student before interviewing the student
2121 regarding an alleged incident of misconduct by a district, school,
2222 entity, service center, or arrangement employee.
2323 SECTION 2. This Act applies beginning with the 2025-2026
2424 school year.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2025.
