77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the operation of certain metropolitan transit
1010 authorities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 162.356(b), Tax Code, is amended to read
1313 as follows:
1414 (b) The exemption provided by Subsection (a)(11) does not
1515 apply to compressed natural gas or liquefied natural gas delivered
1616 into the fuel supply tank of a motor vehicle from a refueling
1717 facility accessible to motor vehicles other than:
1818 (1) motor vehicles [those] described by Subsection
1919 (a)(11)(A); or
2020 (2) motor vehicles exempt from the tax imposed by this
2121 subchapter under another provision of Subsection (a), if the:
2222 (A) refueling facility is operated by a
2323 metropolitan rapid transit authority operating under Chapter 451,
2424 Transportation Code, in which the principal municipality has a
2525 population of less than 320,000; and
2626 (B) use of the refueling facility by those
2727 vehicles is limited to emergencies and other exigent circumstances
2828 as provided by an interlocal agreement under Chapter 791,
2929 Government Code.
3030 SECTION 2. Section 451.061(d-1), Transportation Code, is
3131 amended to read as follows:
3232 (d-1) The establishment of or a change to fares, tolls,
3333 charges, rents, and other compensation by an authority [confirmed
3434 before July 1, 1985,] in which the principal municipality has a
3535 population of less than 1.3 million[,] takes effect immediately on
3636 approval by a majority vote of the board, except that the
3737 establishment of or a change to a single-ride base fare takes effect
3838 on the 60th day after the date the board approves the fare or change
3939 to the fare, unless the policy board of the metropolitan planning
4040 organization that serves the area of the authority disapproves the
4141 fare or change to the fare by a majority vote.
4242 SECTION 3. Section 451.506, Transportation Code, is amended
4343 by adding Subsection (b-1) to read as follows:
4444 (b-1) This subsection applies only to an individual serving
4545 on the board of an authority in which the principal municipality has
4646 a population of less than 320,000. For purposes of Subsection (b),
4747 in determining the length of service on the board of an individual
4848 to whom this subsection applies the following periods of service
4949 are excluded:
5050 (1) a period of service that results from the
5151 individual's appointment to fill an unexpired term that occurs
5252 before the individual's first appointment to a full term on the
5353 board; or
5454 (2) a period of service on the board that is
5555 attributable to a term shortened by the individual's appointment as
5656 the board's presiding officer under Section 451.502(e).
5757 SECTION 4. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2025.
