| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 433.0245, Health and Safety Code, is |
|---|
| 10 | 12 | | amended by amending Subsections (a-1) and (f) and adding Subsection |
|---|
| 11 | 13 | | (a-2) to read as follows: |
|---|
| 12 | 14 | | (a-1) For purposes of this section, a low-volume livestock |
|---|
| 13 | 15 | | processing establishment includes an establishment that processes, |
|---|
| 14 | 16 | | in a calendar year: |
|---|
| 15 | 17 | | (1) includes an establishment that processes fewer |
|---|
| 16 | 18 | | than 10,000 domestic rabbits or more than 1,000 but fewer than |
|---|
| 17 | 19 | | 10,000 poultry [in a calendar year; and |
|---|
| 18 | 20 | | (2) does not include an establishment that processes |
|---|
| 19 | 21 | | 1,000 or fewer poultry raised by the operator of the establishment |
|---|
| 20 | 22 | | in a calendar year]; |
|---|
| 21 | 23 | | (2) fewer than 400 domestic swine; |
|---|
| 22 | 24 | | (3) fewer than 800 sheep; |
|---|
| 23 | 25 | | (4) fewer than 1000 goats; or |
|---|
| 24 | 26 | | (5) fewer than 100 cattle. |

| 25 | 27 | | (a-2) For purposes of this section, a low-volume livestock |

| 26 | 28 | | processing establishment does not include an establishment that |
|---|
| 27 | 29 | | processes 1,000 or fewer poultry raised by the operator of the |
|---|
| 28 | 30 | | establishment in a calendar year. |

| 29 | 31 | | (f) An establishment described by Subsection |

| 30 | 32 | | (a-2)[(a-1)(2)]: |

| 31 | 33 | | (1) is not subject to additional state regulation; and |

| 32 | 34 | | (2) may sell poultry products directly to consumers. |

| 33 | 35 | | SECTION 2. This Act takes effect September 1, 2025. |
