77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the issuance of certain package store permits and the
1010 transfer of package store permits to another location.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.08, Alcoholic Beverage Code, is
1313 amended to read as follows:
1414 Sec. 11.08. CHANGE OF LOCATION. If a permittee, other than
1515 a package store permittee, desires to change the location of the
1616 permittee's [his] place of business, the permittee [he] may file an
1717 application for a change of location with the commission. The
1818 application shall be on a form prescribed by the commission. The
1919 commission or administrator may deny the application on any ground
2020 for which an original application may be denied. The application is
2121 subject to protest and hearing in the same manner as an original
2222 application for a permit.
2323 SECTION 2. Section 22.041(a), Alcoholic Beverage Code, is
2424 amended to read as follows:
2525 (a) The commission may issue an original package store
2626 permit to a person for an existing package store business if:
2727 (1) the person acquired by purchase or otherwise the
2828 existing package store business; [and]
2929 (2) the existing package store business has been
3030 operating in the same location [county] for more than one year
3131 before the date the person acquired the package store business; and
3232 (3) the permit is for the same location as the existing
3333 package store business.
3434 SECTION 3. Section 22.05, Alcoholic Beverage Code, is
3535 amended to read as follows:
3636 Sec. 22.05. TRANSFER OF PERMITS PROHIBITED. The holder of a
3737 package store permit may not transfer the permit to another
3838 location [county].
3939 SECTION 4. This Act takes effect September 1, 2025.
