| 9 | 9 | | relating to the issuance of certain package store permits and the |

| 10 | 10 | | transfer of package store permits to another location. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 11.08, Alcoholic Beverage Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | Sec. 11.08. CHANGE OF LOCATION. If a permittee, other than |
|---|
| 15 | 15 | | a package store permittee, desires to change the location of the |
|---|
| 16 | 16 | | permittee's [his] place of business, the permittee [he] may file an |
|---|
| 17 | 17 | | application for a change of location with the commission. The |
|---|
| 18 | 18 | | application shall be on a form prescribed by the commission. The |
|---|
| 19 | 19 | | commission or administrator may deny the application on any ground |
|---|
| 20 | 20 | | for which an original application may be denied. The application is |
|---|
| 21 | 21 | | subject to protest and hearing in the same manner as an original |
|---|
| 22 | 22 | | application for a permit. |

| 23 | 23 | | SECTION 2. Section 22.041(a), Alcoholic Beverage Code, is |
|---|
| 24 | 24 | | amended to read as follows: |
|---|
| 25 | 25 | | (a) The commission may issue an original package store |
|---|
| 26 | 26 | | permit to a person for an existing package store business if: |
|---|
| 27 | 27 | | (1) the person acquired by purchase or otherwise the |
|---|
| 28 | 28 | | existing package store business; [and] |
|---|
| 29 | 29 | | (2) the existing package store business has been |
|---|
| 30 | 30 | | operating in the same location [county] for more than one year |
|---|
| 31 | 31 | | before the date the person acquired the package store business; and |
|---|
| 32 | 32 | | (3) the permit is for the same location as the existing |
|---|
| 33 | 33 | | package store business. |
|---|
| 34 | 34 | | SECTION 3. Section 22.05, Alcoholic Beverage Code, is |
|---|
| 35 | 35 | | amended to read as follows: |
|---|
| 36 | 36 | | Sec. 22.05. TRANSFER OF PERMITS PROHIBITED. The holder of a |
|---|
| 37 | 37 | | package store permit may not transfer the permit to another |
|---|
| 38 | 38 | | location [county]. |
|---|
| 39 | 39 | | SECTION 4. This Act takes effect September 1, 2025. |
