66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the criminal penalty for practicing chiropractic
99 without a license; increasing a criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 201.605, Occupations Code, is amended to
1212 read as follows:
1313 Sec. 201.605. CRIMINAL PENALTY: PRACTICE WITHOUT LICENSE.
1414 (a) A person commits an offense if the person violates Section
1515 201.301.
1616 (b) An [Except as provided by Subsection (c), an] offense
1717 under this section is a felony of the third degree [Class A
1818 misdemeanor].
1919 (c) [If it is shown on the trial of the offense that the
2020 defendant has been previously convicted under Subsection (a), the
2121 offense is a felony of the third degree.]
2222 [(d)] Each day of violation constitutes a separate offense.
2323 SECTION 2. The changes in law made by this Act apply only to
2424 an offense committed on or after the effective date of this Act. An
2525 offense committed before the effective date of this Act is governed
2626 by the law in effect when the offense was committed, and the former
2727 law is continued in effect for that purpose. For purposes of this
2828 section, an offense was committed before the effective date of this
2929 Act if any element of the offense occurred before that date.
3030 SECTION 3. This Act takes effect September 1, 2025.
