9 | 9 | | relating to the collection of certain incident-based data reported |

10 | 10 | | to the Texas Commission on Law Enforcement. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 1701.164, Occupations Code, is amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | Sec. 1701.164. COLLECTION OF CERTAIN INCIDENT-BASED DATA |
---|
15 | 15 | | SUBMITTED BY LAW ENFORCEMENT AGENCIES. (a) The commission shall |
---|
16 | 16 | | collect and maintain incident-based data submitted to the |
---|
17 | 17 | | commission under Article 2B.0055, Code of Criminal Procedure, |
---|
18 | 18 | | including incident-based data compiled by a law enforcement agency |
---|
19 | 19 | | from reports received by the law enforcement agency under Article |
---|
20 | 20 | | 2B.0054 of that code. |
---|
21 | 21 | | (b) The commission in consultation with the Department of |
---|
22 | 22 | | Public Safety, the Bill Blackwood Law Enforcement Management |
---|
23 | 23 | | Institute of Texas, the W. W. Caruth, Jr., Police Institute at |
---|
24 | 24 | | Dallas, and the Texas Police Chiefs Association shall develop: |
---|
25 | 25 | | (1) guidelines for submitting in a standard format the |
---|
26 | 26 | | report containing incident-based data as required by Article |
---|
27 | 27 | | 2B.0055, Code of Criminal Procedure; and |
---|
28 | 28 | | (2) policies to ensure the quality and accuracy of the |
---|
29 | 29 | | data in a report described by Subdivision (1). |
---|
30 | 30 | | (c) Not later than January 1 of every odd-numbered year, the |
---|
31 | 31 | | commission shall review, and revise as necessary, the guidelines |
---|
32 | 32 | | and policies required under Subsection (b) to ensure that the |
---|
33 | 33 | | incident-based data described by Subsection (a) is of the quality |
---|
34 | 34 | | necessary to enable academic research and reporting based on the |
---|
35 | 35 | | data. |
---|
36 | 36 | | (d) The commission shall make available on the commission's |
---|
37 | 37 | | publicly accessible Internet website: |
---|
38 | 38 | | (1) other than any information that is not subject to |
---|
39 | 39 | | disclosure under Chapter 552, Government Code, the incident-based |
---|
40 | 40 | | data described by Subsection (a) in a format that enables the public |
---|
41 | 41 | | to obtain an electronic copy and readily access the information; |
---|
42 | 42 | | and |
---|
43 | 43 | | (2) a glossary of terms relating to the incident-based |
---|
44 | 44 | | data described by Subsection (a) that assists the public in |
---|
45 | 45 | | understanding the data. |
---|
46 | 46 | | SECTION 2. Subchapter D, Chapter 1701, Occupations Code, is |
---|
47 | 47 | | amended by adding Section 1701.1645 to read as follows: |
---|
48 | 48 | | Sec. 1701.1645. STUDY ON IMPROVED COLLECTION OF |
---|
49 | 49 | | INCIDENT-BASED DATA. (a) The commission shall conduct a study on |
---|
50 | 50 | | the incident-based data described by Section 1701.164(a) and, based |
---|
51 | 51 | | on the findings of that study, make recommendations regarding: |
---|
52 | 52 | | (1) improving the quality of the incident-based data |
---|
53 | 53 | | collected under Article 2B.0054, Code of Criminal Procedure; |
---|
54 | 54 | | (2) reducing any redundant reporting or regulatory |
---|
55 | 55 | | requirements; and |
---|
56 | 56 | | (3) the feasibility of: |
---|
57 | 57 | | (A) collecting and reporting data not subject to |
---|
58 | 58 | | Article 2B.0054, Code of Criminal Procedure, regarding encounters |
---|
59 | 59 | | between peace officers and members of the public, including each |
---|
60 | 60 | | detention by a peace officer of a pedestrian; and |
---|
61 | 61 | | (B) collecting sufficient data to support a |
---|
62 | 62 | | multivariate analysis. |
---|
63 | 63 | | (b) Not later than January 1, 2027, the commission shall |
---|
64 | 64 | | report the study's findings and recommendations under Subsection |
---|
65 | 65 | | (a) to the governor, the lieutenant governor, the speaker of the |
---|
66 | 66 | | house of representatives, and each member of the legislature. |
---|
67 | 67 | | (c) This section expires September 1, 2027. |
---|
68 | 68 | | SECTION 3. This Act takes effect September 1, 2025. |
