77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the collection of certain incident-based data reported
1010 to the Texas Commission on Law Enforcement.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1701.164, Occupations Code, is amended
1313 to read as follows:
1414 Sec. 1701.164. COLLECTION OF CERTAIN INCIDENT-BASED DATA
1515 SUBMITTED BY LAW ENFORCEMENT AGENCIES. (a) The commission shall
1616 collect and maintain incident-based data submitted to the
1717 commission under Article 2B.0055, Code of Criminal Procedure,
1818 including incident-based data compiled by a law enforcement agency
1919 from reports received by the law enforcement agency under Article
2020 2B.0054 of that code.
2121 (b) The commission in consultation with the Department of
2222 Public Safety, the Bill Blackwood Law Enforcement Management
2323 Institute of Texas, the W. W. Caruth, Jr., Police Institute at
2424 Dallas, and the Texas Police Chiefs Association shall develop:
2525 (1) guidelines for submitting in a standard format the
2626 report containing incident-based data as required by Article
2727 2B.0055, Code of Criminal Procedure; and
2828 (2) policies to ensure the quality and accuracy of the
2929 data in a report described by Subdivision (1).
3030 (c) Not later than January 1 of every odd-numbered year, the
3131 commission shall review, and revise as necessary, the guidelines
3232 and policies required under Subsection (b) to ensure that the
3333 incident-based data described by Subsection (a) is of the quality
3434 necessary to enable academic research and reporting based on the
3535 data.
3636 (d) The commission shall make available on the commission's
3737 publicly accessible Internet website:
3838 (1) other than any information that is not subject to
3939 disclosure under Chapter 552, Government Code, the incident-based
4040 data described by Subsection (a) in a format that enables the public
4141 to obtain an electronic copy and readily access the information;
4242 and
4343 (2) a glossary of terms relating to the incident-based
4444 data described by Subsection (a) that assists the public in
4545 understanding the data.
4646 SECTION 2. Subchapter D, Chapter 1701, Occupations Code, is
4747 amended by adding Section 1701.1645 to read as follows:
4848 Sec. 1701.1645. STUDY ON IMPROVED COLLECTION OF
4949 INCIDENT-BASED DATA. (a) The commission shall conduct a study on
5050 the incident-based data described by Section 1701.164(a) and, based
5151 on the findings of that study, make recommendations regarding:
5252 (1) improving the quality of the incident-based data
5353 collected under Article 2B.0054, Code of Criminal Procedure;
5454 (2) reducing any redundant reporting or regulatory
5555 requirements; and
5656 (3) the feasibility of:
5757 (A) collecting and reporting data not subject to
5858 Article 2B.0054, Code of Criminal Procedure, regarding encounters
5959 between peace officers and members of the public, including each
6060 detention by a peace officer of a pedestrian; and
6161 (B) collecting sufficient data to support a
6262 multivariate analysis.
6363 (b) Not later than January 1, 2027, the commission shall
6464 report the study's findings and recommendations under Subsection
6565 (a) to the governor, the lieutenant governor, the speaker of the
6666 house of representatives, and each member of the legislature.
6767 (c) This section expires September 1, 2027.
6868 SECTION 3. This Act takes effect September 1, 2025.
